Align your credentials to specialty occupation standards
USCIS requires your degree to directly relate to EHS management duties. A degree in environmental science, industrial hygiene, or occupational safety strengthens your petition. Certifications like CSP or CIH can reinforce the specialty occupation argument.
Target industries with repeat H-1B LCA filings
Chemical manufacturers, aerospace firms, and large construction contractors file LCAs for EHS roles consistently. Check OFLC disclosure data filtered by SOC code 11-9199 to identify employers who have sponsored this role before.
Search verified EHS sponsoring employers on Migrate Mate
Use Migrate Mate to filter Environmental Health and Safety Manager roles by employers with documented H-1B LCA filing history. This cuts out guesswork and surfaces companies already familiar with sponsoring EHS hires.
Negotiate LCA filing before your start date
Your employer must file the LCA with DOL and receive certification before USCIS sees the I-129 petition. Confirm your target start date allows at least two to three weeks for LCA processing ahead of petition submission.
Verify prevailing wage level matches your responsibilities
Use the OFLC Wage Search to look up the prevailing wage for EHS Manager under SOC 11-9199 in your work location. Wage Level III or IV typically applies to roles with supervisory or multi-site compliance scope.
Use O*NET to document specialty occupation duties
Pull the O*NET profile for Environmental Health and Safety Managers to match your job description language to recognized specialty duties. Employers and attorneys use this to support the specialty occupation determination in the I-129 filing.
H-1B Visa Environmental Health And Safety Manager: Frequently Asked Questions
Does an Environmental Health and Safety Manager role qualify as an H-1B specialty occupation?
Yes, when the position requires a bachelor's degree or higher in a directly related field such as environmental science, industrial hygiene, occupational health, or chemical engineering. Generic management experience without a degree in a specific technical discipline weakens the specialty occupation argument. Roles with regulatory compliance, hazardous materials oversight, or industrial hygiene responsibilities typically satisfy USCIS's definition.
Which industries sponsor H-1B visas most often for EHS Manager roles?
Manufacturing, oil and gas, aerospace, pharmaceuticals, and large construction contractors are the most consistent H-1B sponsors for EHS professionals. These industries operate under strict OSHA, EPA, and DOT regulatory frameworks that require credentialed EHS staff. You can browse employers with verified H-1B LCA filing history in this role on Migrate Mate.
Can my employer file an H-1B petition for an EHS Manager role without a PERM labor certification?
Yes. The H-1B visa is a nonimmigrant classification that does not require PERM labor certification. PERM applies to permanent residence sponsorship, not H-1B petitions. Your employer files a Labor Condition Application with DOL to certify the offered wage meets the prevailing wage for the role and location, which is a separate and faster process than PERM.
How does the prevailing wage requirement affect H-1B sponsorship for EHS Manager positions?
DOL requires employers to pay at least the prevailing wage for the specific EHS Manager role, location, and wage level before certifying the LCA. Roles with multi-site oversight, direct reports, or senior regulatory authority typically fall at Wage Level III or IV. You can verify the applicable prevailing wage for your work location using the OFLC Wage Search before accepting an offer.
Does holding a Certified Safety Professional or Certified Industrial Hygienist credential help my H-1B petition?
It can, particularly if your academic degree is not in a field that maps directly to the job duties. USCIS evaluates specialty occupation based on the degree requirement, not professional certifications alone. A CSP or CIH credential strengthens the argument that the role requires specialized knowledge, but it works best alongside a relevant degree in occupational safety, environmental science, or a related technical discipline.
