Verify your degree meets specialty occupation
USCIS requires a directly related bachelor's degree for H-1B approval. A hospitality management, food science, or culinary arts degree strengthens your case. General business degrees may draw an RFE if the job description doesn't specify a degree field requirement.
Target institutional and contract dining employers
Hospital systems, university dining programs, and contract food service companies like Aramark or Sodexo file LCAs at higher volumes than independent restaurants. These employers have dedicated HR teams experienced with H-1B petitions and established USCIS filing workflows.
Search LCA filing history on Migrate Mate
Pull DOL Labor Condition Application data by occupation code on Migrate Mate to see which employers have filed for Food Service Manager roles. This filters out companies that have never sponsored the title, saving you from pursuing dead ends.
Confirm prevailing wage tier before negotiating
Your offered salary must meet the DOL prevailing wage for your specific job location. Use the OFLC Wage Search to check Level I through IV wages for SOC code 11-9051 before entering salary discussions so you don't accept an offer that can't support an LCA.
Ask employers about cap-exempt filing options
Food Service Managers at qualifying nonprofit hospitals, university dining operations, or research institutions may be cap-exempt, meaning your H-1B can be filed any time of year without entering the lottery. Confirm the employer's tax status and affiliation before assuming you need to wait for April registration.
Document operational scope in your job description
USCIS scrutinizes Food Service Manager petitions by looking for degree-level theoretical and practical knowledge requirements. Work with your employer to specify budget authority, regulatory compliance duties, and multi-unit oversight in the offer letter to distinguish the role from hourly supervisory positions.
H-1B Visa Food Service Manager: Frequently Asked Questions
Does a Food Service Manager role qualify as a specialty occupation for H-1B?
It can, but it's not automatic. USCIS requires the position to normally demand a bachelor's degree or higher in a specific field like hospitality management, food science, or nutrition. Roles focused on operational execution without theoretical degree requirements are vulnerable to RFEs. The job description must clearly connect degree-level knowledge to daily duties.
Which types of employers sponsor H-1B visas for Food Service Manager roles?
Hospital and healthcare systems, university dining programs, hotel groups, and contract food service operators file the most H-1B LCAs for this occupation. Independent restaurants rarely sponsor because the administrative cost outweighs the hiring volume. Use Migrate Mate to browse employers with verified LCA filing history for Food Service Manager positions by location.
How does the DOL prevailing wage apply to Food Service Manager H-1B petitions?
Your employer must pay at least the prevailing wage for SOC code 11-9051 in your specific metropolitan area, as certified through the LCA process. The wage level depends on your experience and job complexity, ranging from Level I to Level IV. Use the OFLC Wage Search to look up the current wage for your work location before signing an offer.
Can a Food Service Manager be hired H-1B cap-exempt?
Yes, if your employer qualifies. Nonprofit hospitals, university food service departments, and research institutions affiliated with higher education may be cap-exempt. This means your petition can be filed at any point in the year without the April lottery. Ask HR to confirm the organization's 501(c)(3) status and any higher-education affiliation before counting on this path.
What happens to my H-1B status if I change Food Service Manager employers?
You can transfer your H-1B to a new employer through an H-1B portability filing before your current status expires. Your new employer files a new I-129 petition with USCIS, and you can begin work as soon as it's received, without waiting for approval. The new LCA must cover your updated work location and meet the local prevailing wage for the role.
