Document your degree's direct field alignment
USCIS scrutinizes Marketing Executive petitions when the degree field isn't explicitly marketing or business. Pull your transcripts and map core coursework to the role's SOC code before your employer files the I-129.
Use OFLC Wage Search before salary negotiations
Look up the prevailing wage for Marketing Executive roles in your target metro using OFLC Wage Search. Knowing the Level I through Level IV thresholds stops you from accepting an offer your employer legally can't certify.
Target employers with dedicated immigration counsel
Companies that handle H-1B filings in-house often delay LCA certification or underprepare RFE responses. Ask recruiters directly whether the company retains outside immigration attorneys before you advance in the process.
Search H-1B-sponsoring employers on Migrate Mate
Filter by Marketing Executive roles on Migrate Mate to surface employers with verified H-1B LCA filing history in marketing. This cuts out companies that list roles but have never actually sponsored the occupation.
Verify your job duties match the O*NET profile
Review the O*NET occupation profile for Marketing Executives before your employer drafts the support letter. If your daily tasks skew heavily toward sales or operations, the petition description needs careful scoping to hold up at adjudication.
Clarify sponsorship timing before accepting an offer
Marketing Executive hires often involve a gap between offer acceptance and H-1B start date. Confirm whether the employer will file for the October 1 cap-subject start or sponsor a cap-exempt transfer if you're already in H-1B status.
H-1B Visa Marketing Executive: Frequently Asked Questions
Does a Marketing Executive role qualify as a specialty occupation for H-1B purposes?
Yes, if the position genuinely requires a bachelor's degree or higher in a specific field like marketing, communications, or business administration. USCIS has issued RFEs on marketing roles where the employer's job description allowed any business-related degree. A tightly written support letter tying the role's analytical and strategic duties to a specific field significantly strengthens the petition.
How do I find employers who have actually sponsored H-1B visas for Marketing Executive roles?
Use Migrate Mate to search Marketing Executive positions filtered by verified H-1B LCA filing history. DOL LCA disclosure data shows which companies have certified prevailing wages for this specific occupation, so you're not guessing based on a company's general reputation for sponsorship.
Can my employer start the H-1B process before I receive a formal offer letter?
No. The LCA requires the employer to certify a specific wage for a specific position, so an actual employment relationship must exist before filing begins. Some employers issue a conditional offer letter early and initiate the LCA process simultaneously, but USCIS requires a bona fide job offer at the time of petition submission.
What happens to my H-1B status if I'm promoted from Marketing Manager to Marketing Executive mid-petition?
A material change in job duties, title, or work location generally requires an amended I-129 petition. Moving from a marketing manager role to an executive-level position typically changes the SOC code, prevailing wage level, and required qualifications, all of which trigger an amendment. Your employer should file before the promotion takes effect.
Does the H-1B cap lottery apply to all Marketing Executive sponsorships?
Cap-subject rules apply unless your employer qualifies as cap-exempt, such as a nonprofit research organization or institution of higher education. Most corporate employers sponsoring Marketing Executive roles are cap-subject, meaning your petition enters the annual lottery with an April 1 filing window and an October 1 earliest start date. USCIS confirms selection before your employer proceeds to full petition filing.
