Verify your degree aligns with the role
USCIS requires your degree field to directly relate to brand management. A marketing or business degree qualifies cleanly, but a general arts degree may trigger an RFE. Have your transcripts ready to demonstrate the connection before applying.
Use OFLC Wage Search before negotiating
Your employer's LCA must certify a wage at or above the DOL prevailing wage for Brand Manager in your specific metro area. Pull the Level I through Level IV figures from OFLC Wage Search so you enter salary talks knowing the compliance floor.
Target employers with cap-exempt affiliations
Brand Manager roles at universities, nonprofits attached to higher education, or qualifying research organizations are cap-exempt. These employers can file your H-1B petition year-round without waiting for the March lottery registration window.
Find H-1B sponsors on Migrate Mate
Filter for Brand Manager roles on Migrate Mate to see employers with verified H-1B LCA filing history for this occupation. That filing history tells you sponsorship is already part of their hiring process, not a one-time ask you'd have to negotiate.
Confirm your job description supports specialty occupation
Brand Manager duties vary widely. If your offer letter emphasizes general coordination over strategic brand development, USCIS may question specialty occupation status. Ask your employer to document degree-level analytical and creative responsibilities explicitly in the petition.
Plan around the 60-day grace period when switching roles
If you're moving from one employer to another, your H-1B is employer-specific. You have a 60-day grace period after your last day to have a new I-129 filed. Start the transfer process before you give notice to avoid any gap in authorized status.
H-1B Visa Brand Manager: Frequently Asked Questions
Does a Brand Manager role qualify as a specialty occupation for H-1B purposes?
Yes, provided the position requires at least a bachelor's degree in a directly related field such as marketing, business administration, or communications. Roles focused purely on execution or coordination without degree-level analytical responsibility can face RFEs. The O*NET profile for Marketing Managers supports the specialty occupation classification, and your employer's job description should reflect that level of complexity.
How do I find employers who actively sponsor H-1B visas for Brand Manager positions?
Search for Brand Manager roles on Migrate Mate, which surfaces employers with verified H-1B LCA filing history for this occupation code. DOL LCA disclosure data is public, so you can confirm that a specific employer has filed for comparable roles before accepting an offer or investing time in a lengthy interview process.
Can my employer file my H-1B petition outside the annual lottery cap?
Only if you're working for a cap-exempt organization such as a university, a nonprofit affiliated with higher education, or a qualifying government research institution. Most consumer brands, agencies, and startups are cap-subject, meaning your petition must go through the March registration lottery with an October 1 start date if selected.
What happens to my H-1B status if I'm promoted from Brand Manager to a more senior role?
A material change in your job duties, title, or worksite typically requires your employer to file an amended I-129 petition with USCIS before the change takes effect. A promotion within the same occupational category and location is generally lower risk, but a title change that significantly shifts responsibilities warrants an amendment to keep your status in compliance.
How does the LCA process work for Brand Manager H-1B petitions?
Your employer files a Labor Condition Application with the DOL certifying that you'll be paid at least the prevailing wage for Brand Manager in your work location and that hiring you won't adversely affect similarly employed U.S. workers. The DOL must certify the LCA before your employer can submit the I-129 to USCIS. Certification typically takes seven business days under standard processing.
