Verify your role meets specialty occupation
Insurance Sales Agent is SOC code 41-3021. Pull the O*NET profile to confirm the typical education requirement is a bachelor's degree in a specific field. Without that alignment, USCIS can issue an RFE challenging specialty occupation status.
Target employers with LCA filing history
Use Migrate Mate to filter Insurance Sales Agent roles by employers who have filed LCAs for this occupation code before. Prior filings signal that the employer understands the H-1B process and has already cleared internal legal and HR approvals.
Check prevailing wage before salary negotiations
Run the OFLC Wage Search for SOC 41-3021 in your target metro before any offer discussion. Your employer's LCA must certify a wage at or above the DOL prevailing rate, and commission-heavy structures can complicate wage compliance.
Clarify commission structure in your offer letter
Many insurance roles pay a base plus commission. Your H-1B petition must show your guaranteed base salary meets prevailing wage. Get the fixed base confirmed in writing before your employer files Form I-129, since variable pay alone won't satisfy DOL requirements.
Confirm state licensing requirements early
Most states require a property, casualty, or life insurance license before you can sell. Some employers won't file an H-1B petition until you're licensed. Start your state licensing exam process during the offer stage, not after the petition is filed.
Time your petition around the April cap filing window
H-1B cap-subject petitions must be filed for October 1 start dates, with USCIS registration opening in March. If you receive an offer after April, negotiate a start date for the following fiscal year or ask whether the employer qualifies for cap-exempt filing.
H-1B Visa Insurance Sales Agent: Frequently Asked Questions
Does an Insurance Sales Agent role qualify for H-1B sponsorship?
It depends on how the position is structured. USCIS requires a specialty occupation, meaning the role must normally require at least a bachelor's degree in a specific field like finance, business, or economics. Generalist sales roles without a defined degree requirement often don't qualify, but positions at insurers or brokerages requiring quantitative or analytical credentials can. Review the O*NET profile and the job description carefully before applying.
Which types of employers sponsor H-1B visas for insurance sales roles?
Large carriers, regional insurance groups, and financial services conglomerates are the most consistent H-1B sponsors for this occupation. Smaller independent agencies rarely file because the legal and compliance overhead isn't built into their operations. You can browse verified H-1B sponsoring employers for Insurance Sales Agent roles on Migrate Mate, which filters listings by LCA filing history for this specific occupation.
How does commission-based pay affect my H-1B petition?
Your employer's Labor Condition Application must certify that your salary meets the DOL prevailing wage for your occupation and location. Commission income doesn't count toward that threshold. If your base salary is below the prevailing wage for Insurance Sales Agent in your metro, the LCA won't be certified and the H-1B petition can't proceed. Confirm the fixed base meets DOL requirements before your employer files.
Do I need a state insurance license before my employer can file an H-1B petition?
Not necessarily at the petition stage, but many employers require it before extending a formal offer or initiating the H-1B filing process. Insurance sales roles typically require a state license to legally conduct business. If you're still in the licensing process, clarify with the employer whether they'll file the petition while you complete your exam, or whether licensure is a condition precedent to filing.
What happens to my H-1B status if I change employers or move to a different insurance company?
H-1B portability under AC21 allows you to change employers after your petition has been pending for at least 180 days, as long as the new role is in the same or a similar occupational classification. Your new employer must file an H-1B transfer petition before your current status expires. Insurance sales roles transfer more smoothly when both positions share the same SOC code and specialty occupation basis.
