Verify your degree supports specialty occupation
USCIS requires your degree field to directly relate to the Healthcare Sales Specialist role. A life sciences, pharmacology, or business degree strengthens your case. A general studies degree paired with unrelated experience creates RFE risk.
Target employers with LCA filing history
Use Migrate Mate to filter Healthcare Sales Specialist roles by employers who have filed Labor Condition Applications for this occupation. LCA history signals an employer who understands the H-1B process and has done it before.
Confirm the prevailing wage tier before accepting
Run your target metro area and job title through the OFLC Wage Search before negotiating. Your offered salary must meet at least Level I prevailing wage. Offers below that threshold will block LCA certification regardless of employer intent.
Ask whether the employer uses E-Verify
H-1B employers aren't always E-Verify participants, but those who are have already cleared key compliance steps. Ask early in the interview process. Federal contractors are required by law, so targeting that segment narrows your list to pre-qualified sponsors.
Register in March for the April lottery window
The H-1B cap registration period runs in early March each year. Your employer must submit your registration before the window closes. Missing it means waiting a full year. Confirm your employer has a filing timeline in place before accepting an offer contingent on H-1B approval.
Use O*NET to document specialty occupation evidence
Pull the O*NET occupation profile for Healthcare Sales Specialist and document the degree requirements listed. Your employer's attorney needs this to support the specialty occupation argument in the I-129 petition, especially for roles where officers may question whether the job requires a specific bachelor's degree.
H-1B Visa Healthcare Sales Specialist: Frequently Asked Questions
Does a Healthcare Sales Specialist role qualify as a specialty occupation for H-1B purposes?
It depends on how the position is defined. USCIS requires the role to normally require at least a bachelor's degree in a specific field. A Healthcare Sales Specialist tied to pharmaceutical, biotech, or medical device products is more defensible when the employer documents that a degree in life sciences, pharmacology, or clinical research is a genuine job requirement, not a preference.
Which employers sponsor H-1B visas for Healthcare Sales Specialist roles?
Pharmaceutical companies, medical device manufacturers, diagnostics firms, and health IT companies are the most consistent H-1B sponsors for this role. Migrate Mate lets you filter Healthcare Sales Specialist openings by employers with verified LCA filing history, so you're not guessing about willingness to sponsor.
Can I transfer my H-1B to a new Healthcare Sales Specialist employer?
Yes. H-1B portability lets you start working for a new employer as soon as they file the transfer petition, without waiting for approval, as long as your prior H-1B was approved and you've maintained valid status. The new employer files a fresh I-129 and LCA for your new role and location.
What happens to my H-1B status if my territory changes or I'm reassigned to a new state?
Territory changes that move your primary worksite to a new metropolitan statistical area typically require a new LCA. Your employer must file an amended H-1B petition with USCIS if the change is material. Short-term assignments under 60 days may qualify for an exception, but a permanent reassignment to a new region requires the full amendment process.
Is commission-based pay a problem for H-1B prevailing wage compliance in this role?
It can be. USCIS and DOL require that your guaranteed base salary meets the prevailing wage for your occupation and location. Variable compensation like commissions doesn't count toward that floor. If your offer structure relies heavily on commission with a low base, the LCA may not clear DOL review, even if your total on-target earnings look competitive.
