Verify your role meets specialty occupation
USCIS requires Field Sales Representative positions to demand a specific bachelor's degree, not just any degree. Review the O*NET profile for this occupation to confirm the education and knowledge requirements that support your specialty occupation argument before applying.
Target industries with consistent LCA filings
Medical device, enterprise software, and industrial equipment companies file LCAs for Field Sales roles far more regularly than retail or consumer goods firms. Filter your search by industry on Migrate Mate to surface employers with verified H-1B filing history for this title.
Check prevailing wage before negotiating your offer
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your geographic area. Run your job title and location through the OFLC Wage Search before salary discussions so you know the floor your offer must meet.
Ask employers about cap-exempt entity affiliations
Some Field Sales roles are placed with nonprofit research organizations or universities that qualify as cap-exempt employers. If a company has affiliations with qualifying institutions, your H-1B petition could bypass the annual lottery entirely.
Align your offer letter to your degree field explicitly
USCIS scrutinizes Field Sales petitions more than technical roles. Your offer letter should state that the position requires your specific degree discipline, not just a generic bachelor's. Work with your employer's HR team to document this connection before the I-129 is filed.
Account for the 60-day grace period when changing employers
If your current H-1B employer terminates you, USCIS allows a 60-day grace period to find a new sponsoring employer and file an H-1B transfer. Line up your Field Sales job search and have a new petition ready to file before that window closes.
H-1B Visa Field Sales Representative: Frequently Asked Questions
Does a Field Sales Representative role qualify as an H-1B specialty occupation?
It depends on how the position is defined. USCIS requires the role to normally require a bachelor's degree in a specific field such as business, marketing, or a related discipline. Generic sales roles can face RFEs, so the job description must explicitly tie duties to that degree requirement. Roles in technical industries like medical devices or enterprise software tend to pass this test more cleanly.
Which employers sponsor H-1B visas for Field Sales Representative positions?
Employers in medical devices, pharmaceutical sales, enterprise software, and industrial equipment sponsor H-1B visas for Field Sales roles most consistently. These industries require technical knowledge that supports the specialty occupation argument. You can browse verified H-1B sponsoring employers for this role on Migrate Mate, which surfaces companies based on their actual DOL Labor Condition Application filing history.
Can my Field Sales Representative H-1B petition be filed outside the annual cap?
Only if your employer qualifies as a cap-exempt organization, such as a nonprofit research institution or a university. Standard for-profit companies sponsoring Field Sales roles are subject to the 85,000-slot annual cap and the lottery. If your employer has affiliations with qualifying nonprofit or educational entities, ask their immigration counsel whether cap-exempt filing is an option.
How does the DOL prevailing wage requirement affect Field Sales Representative offers?
Your employer must certify on the LCA that your offered wage meets or exceeds the DOL prevailing wage for a Field Sales Representative in your specific work location. This wage floor varies significantly by metro area and experience level. Use the OFLC Wage Search to look up the applicable wage level before you enter salary negotiations so you're not caught off guard after an offer is extended.
What happens to my H-1B status if my Field Sales territory or work location changes?
Significant location changes can trigger an amended H-1B petition requirement. If your employer reassigns you to a new metropolitan area not covered in your original LCA, they must file a new LCA and potentially an amended I-129 before you begin working there. Short-term placements within 60 miles of your certified worksite typically fall under the short-term placement rules and don't require a new filing.
