Verify your degree supports specialty occupation
H-1B approval for Account Executive roles hinges on demonstrating specialty occupation. Pull the O*NET profile for sales managers and account executives to document the degree requirement, then match your transcript field to the job description before applying.
Target cap-exempt employers in your sector
Universities, nonprofit research institutions, and government-affiliated entities are cap-exempt, meaning your H-1B petition bypasses the lottery entirely. SaaS, fintech, and enterprise software firms regularly sponsor commercial sales roles and are worth prioritizing in your search.
Search H-1B filing history on Migrate Mate
Filter by Commercial Account Executive roles on Migrate Mate to see which employers have active LCA filing history with DOL. This lets you focus outreach on companies that have already committed to sponsoring this specific role type.
Request the LCA wage level before accepting an offer
Employers assign your position to a DOL wage level one through four. Level one signals entry-level framing, which can create RFE risk for experienced sales hires. Ask the recruiter which level the LCA uses and cross-check it against the OFLC Wage Search for your metro area.
Align your offer letter language with USCIS requirements
USCIS scrutinizes Account Executive roles because some classifications blur the line between sales and general business. Your offer letter should specify that a bachelor's degree in a directly related field is required, not merely preferred, to support the specialty occupation argument.
Confirm E-Verify enrollment before your start date
If you're transitioning from OPT STEM extension or cap-gap status, your employer must be enrolled in E-Verify to authorize your employment. Confirm enrollment status with HR before your H-1B start date to avoid a gap in work authorization.
H-1B Visa Commercial Account Executive: Frequently Asked Questions
Does a Commercial Account Executive role qualify as an H-1B specialty occupation?
It can, but it's not automatic. USCIS requires that the position normally requires a bachelor's degree or higher in a specific related field, such as business administration, marketing, or finance. If the job description allows any degree or lacks a specific field requirement, USCIS may issue an RFE challenging specialty occupation status. A well-drafted job description that ties the role to specific degree requirements significantly strengthens the petition.
Which industries sponsor H-1B visas most consistently for Commercial Account Executive roles?
Enterprise software, cloud infrastructure, fintech, and healthcare technology companies file LCAs for commercial sales roles regularly because their products require technical knowledge that aligns with a relevant degree. You can browse employers with verified H-1B filing history for this role type on Migrate Mate, which surfaces DOL Labor Condition Application data by job title and employer.
Can my employer file my H-1B petition before the lottery even if I'm still on OPT?
Yes. Employers can submit H-1B registrations during the March lottery window while you're on OPT. If selected, they file the full petition for an October 1 start date. If your OPT expires before October 1 and you're in cap-gap status, your work authorization extends automatically until your H-1B takes effect, provided the petition is timely filed.
What happens to my H-1B if I want to switch employers after getting sponsored?
H-1B portability lets you start working for a new employer as soon as they file a transfer petition, without waiting for approval, as long as your current H-1B was lawfully approved and the new petition is non-frivolous. For Commercial Account Executive roles, make sure the new employer's job description also supports specialty occupation to avoid complications during adjudication.
How does DOL's prevailing wage requirement affect salary negotiations for this role?
Your employer must pay at least the DOL prevailing wage for the LCA wage level assigned to your role in your work location. The prevailing wage floor varies by metro area and wage level, and you can verify the applicable wage using the OFLC Wage Search. Negotiating below that floor isn't possible without risking LCA compliance, so understanding the floor strengthens your negotiating position rather than constraining it.
