Map your degree to the role
USCIS evaluates whether your degree field directly relates to advertising management. A marketing or communications degree is a clean match. A general business degree may require a detailed cover letter from your employer explaining the nexus.
Pull LCA data on Migrate Mate
Search Advertising Manager roles on Migrate Mate to see which employers have certified LCAs for this specific title. Filing history by occupation code tells you who has sponsored the role before, not just who claims to be open to it.
Check prevailing wage before negotiating
Run your target metro area through the OFLC Wage Search before entering salary negotiations. Your employer must pay at least the DOL prevailing wage for your work location, so knowing Level II and Level III thresholds gives you a realistic floor.
Prioritize cap-exempt or returning employers
If you're already on H-1B status with another employer, a new Advertising Manager role can transfer via H-1B portability once the new petition is filed. You don't re-enter the lottery if you're already cap-counted.
Clarify the specialty occupation argument early
Advertising Manager sits on the boundary USCIS scrutinizes because some postings list degrees as preferred rather than required. Ask the hiring manager during the offer stage whether the role requires a specific degree, and request that the job description language reflect that requirement.
Align your O*NET classification with the petition
Your employer's immigration attorney will reference O*NET to classify the role and support the specialty occupation argument. Pull the O*NET profile for Advertising and Promotions Managers yourself so you can confirm your actual duties match the listed tasks before the I-129 is drafted.
H-1B Visa Advertising Manager: Frequently Asked Questions
Does an Advertising Manager role qualify as a specialty occupation for H-1B purposes?
Yes, if the position requires a bachelor's degree or higher in a directly related field such as marketing, advertising, communications, or business with a marketing concentration. The employer must demonstrate that a specific degree is the normal minimum for the role. Generic business degrees without a clear connection to advertising can trigger a Request for Evidence from USCIS.
How do I find employers who have actually sponsored H-1B visas for Advertising Manager roles?
Search Migrate Mate to filter Advertising Manager openings by employers with verified H-1B LCA filing history for that specific occupation code. This is more reliable than a general job search because it surfaces companies that have gone through the DOL certification process for this title, not just employers who say they're open to sponsorship.
Can I transfer my H-1B to a new Advertising Manager job without going through the lottery again?
Yes. H-1B portability under AC21 lets you start working for a new employer as soon as they file the transfer petition, provided your current H-1B was approved and you've maintained valid status. You don't re-enter the lottery because you're already cap-counted. The new employer still files an LCA and I-129 before you begin.
What documentation should I prepare to support a specialty occupation claim for this role?
Gather your official transcripts, degree certificates, and any professional credentials in marketing or advertising. If your degree title doesn't map obviously to the role, a credential evaluation from a NACES-member organization can help. Your employer will also need to document that the position normally requires a specific degree, not just any bachelor's degree.
How long does H-1B sponsorship take for an Advertising Manager position, and when should I start the process?
The DOL LCA certification typically takes seven business days. USCIS then processes the I-129 petition, with standard processing running several months and premium processing available for a faster decision. The H-1B lottery cap registration opens each March for an October 1 start date, so you'll want an employer willing to file at least six months before your intended start.
