Frame your degree as field-specific
Digital marketing H-1B petitions succeed when your degree directly corresponds to the role. A marketing, communications, or advertising degree strengthens the specialty occupation argument. A general business degree can work, but your employer will need to document why the role requires that specific field.
Search LCA data by occupation code
Use the OFLC Wage Search to filter Labor Condition Applications by the SOC code for your target role, such as 11-2021 for marketing managers. This shows which employers have already certified LCAs for digital marketing positions, narrowing your search to proven sponsors.
Target employers with existing marketing H-1B history
Use Migrate Mate to filter companies by verified H-1B filing history in digital marketing roles. Employers who have sponsored before understand the process, reducing the risk that a strong offer falls apart over sponsorship concerns.
Clarify job duties before the LCA is filed
USCIS scrutinizes digital marketing petitions where duties mix strategic and tactical tasks. Before your employer files the LCA with DOL, confirm the job description emphasizes degree-level responsibilities like campaign strategy, analytics interpretation, or budget management, not execution-only tasks.
Check the prevailing wage level tied to your duties
DOL assigns prevailing wage levels based on complexity of duties, not job title. A digital marketing analyst role with data modeling responsibilities may land at a higher wage level than the same title at a company focused on social posting. Verify the wage level in the OFLC Wage Search before accepting an offer.
File during the cap window with documentation ready
H-1B cap registration opens in March for an October 1 start. Have your degree transcripts, credential evaluation if needed, and a detailed job description ready before your employer files Form I-129. Late or incomplete documentation is the most common reason for Requests for Evidence in marketing petitions.
H-1B Visa Digital Marketing: Frequently Asked Questions
Does a digital marketing role qualify as an H-1B specialty occupation?
It depends on how the position is defined. Digital marketing roles qualify when they require a bachelor's degree in a specific field, such as marketing, communications, or data analytics, and the duties involve degree-level judgment, not just execution. Roles focused on strategy, performance analysis, or marketing technology tend to qualify more cleanly than generalist or coordinator-level positions. USCIS evaluates each petition on its own facts.
Which digital marketing job titles are most commonly sponsored for H-1B visas?
Marketing managers, SEO specialists, digital marketing analysts, paid media strategists, and marketing operations roles appear frequently in H-1B LCA filings. Titles that combine analytical and strategic responsibilities, such as growth marketing manager or marketing data analyst, are more defensible as specialty occupations than titles suggesting administrative or support work. You can verify which titles have active LCA filings using the OFLC Wage Search.
How do I find digital marketing employers who sponsor H-1B visas?
Migrate Mate filters companies by verified H-1B filing history in digital marketing roles, so you can focus your applications on employers who have already gone through the sponsorship process. E-commerce companies, SaaS platforms, media agencies, and large tech firms tend to sponsor most consistently. Searching by DOL LCA data, rather than job postings alone, gives you a clearer picture of actual sponsorship behavior.
What happens to my H-1B if my digital marketing job role changes significantly?
A material change in job duties, location, or employer requires an amended H-1B petition filed with USCIS before the change takes effect. For digital marketing professionals, this is relevant when a role shifts from a specialty occupation, such as SEO strategy, to a generalist marketing function. Your employer files the amendment, and you can continue working during adjudication if the petition is filed on time.
Can a digital marketing agency sponsor H-1B visas, or only in-house corporate roles?
Agencies can sponsor H-1B visas, but USCIS may scrutinize petitions where employees work at client sites rather than the sponsoring employer's location. If your agency role places you on-site at a client's office, your employer needs to document that it controls your work, sets your schedule, and directs your duties. In-house marketing roles at a single employer carry less risk of an employer-employee relationship challenge.
