Get Access To All JobsTips for Finding H-1B Visa Sponsorship in Sales Business Development
Verify your role meets specialty occupation
Sales Business Development titles vary widely. Pull the O*NET profile for your specific role to confirm it requires a bachelor's degree in a directly related field, not just any degree. A generic sales title without degree requirements can trigger an RFE.
Target employers with LCA filing history
Use Migrate Mate to filter Sales Business Development roles by employers who have actively filed LCAs for this occupation. DOL disclosure data shows which companies sponsor consistently, not just occasionally, so you can prioritize outreach accordingly.
Ask about cap-exempt employer status early
Universities, nonprofits affiliated with research institutions, and certain government entities are cap-exempt. If you miss the lottery, a cap-exempt employer in business development or partnerships can file your H-1B petition at any time of year.
Confirm your offer letter specifies SOC code
Your employer's LCA must list a Standard Occupational Classification code. For business development roles, the SOC code affects the prevailing wage level. Check the OFLC Wage Search to see what wage level your job duties actually correspond to before signing.
Negotiate start dates around the October 1 cap timeline
Cap-subject H-1B petitions approved in the April lottery have an October 1 start date. Build that into your offer negotiation. Employers in Sales Business Development sometimes assume immediate starts are possible, so clarifying the USCIS timeline upfront avoids rescinded offers.
Prepare a degree-to-role nexus document
USCIS scrutinizes business development roles more than engineering roles. Draft a one-page summary connecting your degree coursework directly to your job duties before interviews. Employers who see this are better prepared to write a strong specialty occupation support letter.
H-1B Visa Sales Business Development: Frequently Asked Questions
Do Sales Business Development jobs typically qualify for H-1B sponsorship?
They can, but the title alone doesn't guarantee qualification. The role must require a bachelor's degree in a specific field like business, marketing, or economics as a minimum entry requirement. Roles framed as relationship-building or account management without a defined degree requirement are more likely to receive an RFE from USCIS. The job description your employer writes for the LCA filing is critical.
How do I find Sales Business Development employers who sponsor H-1B visas?
Migrate Mate surfaces Sales Business Development roles filtered by employers with active H-1B LCA filing history, so you're not applying blind. DOL discloses LCA data publicly, and Migrate Mate organizes it by occupation and employer so you can see sponsorship patterns before you apply.
Can my employer file an H-1B for a business development role that includes commission-based pay?
Yes, but the base salary must meet the prevailing wage for the SOC code listed on the LCA. USCIS and DOL look at the guaranteed base, not total on-target earnings including commission. If your base falls below the prevailing wage threshold, the LCA won't be certified, regardless of how high your commission potential is.
What happens to my H-1B if I'm promoted from Sales Business Development to a management role?
A material change in job duties, title, or work location requires your employer to file an amended H-1B petition with USCIS. A promotion to a manager or director role with different core duties counts as a material change. Your employer's immigration counsel should assess whether an amendment is needed before the promotion takes effect, not after.
Is there a grace period if my Sales Business Development employer terminates my H-1B early?
USCIS provides a 60-day grace period after involuntary termination. During that window, you can start a new job search, receive a new H-1B transfer from another employer, or change status. The 60-day period doesn't reset with each job change, so moving quickly to secure a new H-1B transfer petition or alternative status is essential.
