Verify your degree field matches the role
USCIS requires a direct relationship between your degree and the Business Development Assistant duties. A business, marketing, or economics degree supports the petition. A degree in an unrelated field may trigger an RFE, so confirm alignment before applying.
Look up prevailing wage before negotiating
Use the OFLC Wage Search to find the Level I and Level II prevailing wages for your target SOC code and work location. Your offered salary must meet the certified LCA wage, so knowing the floor before salary discussions protects you.
Target employers with active LCA filing history
Filter your job search on Migrate Mate by employers who have filed LCAs for business development roles. This shows real H-1B intent, not just a checkbox on a job posting, and saves you from pursuing companies that don't sponsor.
Clarify sponsorship scope during the offer stage
Ask explicitly whether the employer covers the I-129 filing fee and attorney costs, or expects you to contribute. Some smaller companies sponsor the status but shift legal fees to the employee, which affects your total compensation math.
Check the job description against O*NET qualifications
The O*NET profile for your target SOC code lists typical education and skill requirements. If the posted duties align with O*NET's specialty occupation criteria, you have stronger ground when USCIS evaluates whether the role qualifies for H-1B classification.
Account for the 60-day grace period when switching roles
If you're changing employers after a layoff or job change, you have 60 days to secure a new H-1B transfer or file a cap-exempt petition. Don't wait for a final offer to start conversations with prospective employers about their filing timeline.
H-1B Visa Business Development Assistant: Frequently Asked Questions
Does a Business Development Assistant role qualify as a specialty occupation for H-1B purposes?
It depends on how the employer defines the role. USCIS requires that a bachelor's degree in a specific field, such as business, marketing, or economics, be a normal minimum requirement for the position. Generic assistant roles with vague duties are more likely to receive an RFE. Roles with defined analytical, strategic, or client-facing responsibilities tied to a relevant degree field are stronger candidates for H-1B approval.
How do I find employers who actually sponsor H-1B visas for business development roles?
Migrate Mate surfaces employers with verified LCA filing history for business development and sales operations roles, so you can see which companies have actively sponsored H-1B workers rather than relying on unverified job posting claims. DOL LCA disclosure data is public, and filtering by occupation code gives you a concrete list of real sponsors to prioritize in your search.
Can my employer file an H-1B petition for a Business Development Assistant position if I'm currently on OPT?
Yes. If you're on OPT and your employer wants to retain you, they can file an H-1B cap-subject petition during the annual registration window, typically in March. If you're on STEM OPT, your extended work authorization may bridge the gap between your OPT end date and the October 1 H-1B start date through the cap-gap rule, provided the petition is filed on time.
What happens to my H-1B if my employer changes my title from Business Development Assistant to a different role?
A material change in job duties, location, or salary may require your employer to file an amended H-1B petition with USCIS before the change takes effect. A title-only change without substantive duty changes is lower risk, but if the new role falls under a different SOC code or adds significantly different responsibilities, an amended filing protects your status and avoids compliance exposure.
Does the size of the employer affect H-1B sponsorship for this role?
Employer size affects cost structure, not eligibility. Large companies with 50 or more U.S. employees where more than half hold H-1B or L-1 visa status pay higher ACWIA training fees. Smaller employers pay lower fees, which can make them more willing to sponsor roles like Business Development Assistant that are sometimes seen as borderline for specialty occupation status. Always confirm who covers the filing costs during offer negotiations.
