Document your partnership marketing credentials clearly
Pull together campaign performance data, co-marketing contracts, and channel partner metrics before applying. USCIS adjudicators evaluate specialty occupation based on degree-to-role alignment, so concrete evidence that your work requires specialized marketing knowledge strengthens the petition.
Use O*NET to validate your job description
The O*NET occupation profile for Marketing Managers defines the knowledge domains and degree requirements USCIS relies on. Confirm your target job posting aligns with those descriptions before accepting an offer, since mismatched titles can trigger an RFE.
Target employers with active LCA filing history
Search Migrate Mate to filter Partner Marketing Manager roles by employers who have filed Labor Condition Applications for marketing positions. Past LCA filings signal that the employer already understands the H-1B process and won't hesitate when it's time to sponsor.
Negotiate your start date around the cap timeline
H-1B cap petitions are filed in April for an October 1 start. If you receive an offer outside that window, ask whether the employer will file for the next fiscal year or has cap-exempt status, such as a nonprofit research institution or university affiliation.
Ask employers about their E-Verify enrollment upfront
E-Verify enrollment is required for all H-1B employers. Raising it early in negotiations isn't unusual, and employers who are already enrolled are more likely to have HR infrastructure in place to manage the DOL's LCA posting and record-keeping requirements without delays.
Benchmark prevailing wage before discussing compensation
Run the OFLC Wage Search for your target city and SOC code before your offer conversation. Your employer must certify on the LCA that your salary meets the prevailing wage, so knowing the Level II and III thresholds for Partner Marketing Manager roles in your metro helps you catch underpaying offers early.
H-1B Visa Partner Marketing Manager: Frequently Asked Questions
Does a Partner Marketing Manager role qualify as a specialty occupation for H-1B purposes?
Yes, provided the position requires at least a bachelor's degree in marketing, business, communications, or a directly related field. The job duties matter as much as the title. Roles focused on strategic alliance development, co-marketing program design, or partner enablement are well-supported as specialty occupations under USCIS guidelines, especially when the employer can document that a specific degree field is standard for the position.
How do I find Partner Marketing Manager employers who actively sponsor H-1B visas?
Search Migrate Mate to browse Partner Marketing Manager jobs filtered by employers with verified H-1B LCA filing history. Employers who have filed Labor Condition Applications for marketing roles in the past have already cleared the DOL process once and are far more likely to sponsor again without requiring internal approvals from scratch.
What happens to my H-1B status if I switch from one partner marketing role to another employer?
You can begin working for a new H-1B employer as soon as they file an H-1B transfer petition with USCIS, under the portability rules established by AC21. You don't need to wait for approval. The new employer must file before your current status expires, and the new role should be in the same or a similar occupational classification as your original approved petition.
Can a startup or small tech company sponsor my H-1B for a Partner Marketing Manager position?
Yes. Company size doesn't affect H-1B eligibility, but smaller employers must still meet DOL prevailing wage requirements, file a certified LCA, and demonstrate they can pay the offered wage. Startups that haven't sponsored before often face longer internal timelines because HR and legal processes aren't yet in place, so ask early in the hiring process whether they've filed H-1B petitions previously.
Does a partner marketing role at a SaaS company get counted toward the H-1B annual cap?
Almost always yes. Most SaaS companies are for-profit entities, so their H-1B petitions count against the 85,000 annual cap. The exception is if the employer is a nonprofit research organization or a higher education institution. If you're evaluating multiple offers, confirming cap-subject status matters because cap-exempt employers can file at any time and don't require lottery selection.
