Verify your credentials meet ECFMG requirements early
If you trained outside the U.S., ECFMG certification and USMLE passage are prerequisites before any employer can file your H-1B petition. Confirm your documentation is complete before targeting roles, since gaps delay the filing window significantly.
Target health systems with cap-exempt H-1B eligibility
Nonprofit hospitals affiliated with universities and certain research institutions can file H-1B petitions outside the annual cap at any time. Prioritizing these employers removes the lottery risk entirely and lets you start sooner.
Search LCA filings filtered for psychiatry leadership roles
Use Migrate Mate to filter employers by LCA filing history for Medical Director and psychiatry-related job codes, so you're only applying to organizations with a documented record of sponsoring this specific role type.
Request premium processing before your offer expires
Standard H-1B adjudication can run several months. Ask the employer to file with premium processing, which commits USCIS to a 15-business-day decision and protects you if you're transitioning from another nonimmigrant status.
Confirm the prevailing wage tier before contract negotiations
Look up the Level III or Level IV wage for your SOC code and work location using the OFLC Wage Search before finalizing any offer. The LCA must certify at or above that figure, so knowing it in advance prevents last-minute contract revisions.
Clarify board certification scope in the specialty occupation letter
Employers' H-1B support letters must establish that the Medical Director role specifically requires a board-certified psychiatrist. Ensure your offer letter and the attorney's specialty occupation analysis reference your ABPN certification explicitly, not just a general physician license.
H-1B Visa Medical Director Psychiatry: Frequently Asked Questions
Does a Medical Director Psychiatry role qualify as an H-1B specialty occupation?
Yes. USCIS recognizes Medical Director Psychiatry as a specialty occupation because it requires at minimum a medical degree, psychiatric residency completion, and typically board certification through the American Board of Psychiatry and Neurology. The role's theoretical and applied knowledge base satisfies the specialty occupation standard. Your employer's attorney will document this in the H-1B petition's support letter.
Which types of employers sponsor H-1B visas for psychiatry medical director positions?
Academic medical centers, nonprofit hospital systems, federally qualified health centers, behavioral health networks, and large multispecialty groups are the most active sponsors for this title. Many of these are cap-exempt, meaning they can file outside the annual lottery. Use Migrate Mate to identify employers with verified LCA filings for medical director and psychiatry job codes in your target region.
How does the H-1B cap lottery affect my job search as a psychiatry medical director candidate?
If the sponsoring employer is a for-profit organization without a qualifying cap-exempt affiliation, your petition enters the annual lottery with an April 1 filing date and an October 1 start date. Cap-exempt employers, including nonprofits affiliated with universities and certain research hospitals, can file year-round. Targeting cap-exempt health systems eliminates lottery timing risk and allows earlier start dates.
Can I transfer my H-1B to a new employer if I change medical director roles?
Yes, through H-1B portability. Your new employer files an H-1B transfer petition before your current authorization ends, and you can begin the new role once USCIS receives the petition, without waiting for approval. The receiving employer must file a new LCA certified at the prevailing wage for your new location and job code before submitting the transfer.
Does a Medical Director Psychiatry role support an EB-1 or EB-2 NIW green card path?
Both pathways are viable depending on your profile. An EB-1B outstanding researcher or professor category suits physicians with a strong publication record and institutional research role. A National Interest Waiver, or NIW, under EB-2 is increasingly used by psychiatrists serving underserved populations, where the national benefit of your work can satisfy the waiver standard without requiring employer PERM sponsorship.
