Verify your ECFMG certification before applying
If you trained outside the U.S., ECFMG certification is a hard requirement before any employer can file your H-1B petition. Confirm your certificate is current and that your medical school appears on the ECFMG-recognized institutions list.
Target cap-exempt employers first
Hospitals, nonprofit health systems, and academic medical centers can file H-1B petitions year-round outside the annual cap. Focus your search on these employers to avoid lottery exposure and file on any timeline that fits your contract start date.
Check prevailing wage before negotiating your offer
Your employer must pay at least the DOL prevailing wage for your specialty and location. Run your job title and geography through the OFLC Wage Search before you negotiate so your offer meets the legal threshold and the LCA clears without delays.
Use Migrate Mate to find H-1B sponsoring physicians employers
Migrate Mate filters employers by verified H-1B LCA filing history, so you're only browsing health systems and practices that have actively sponsored physicians. That removes the guesswork of cold-applying to employers who've never filed a physician petition.
Confirm your specialty license aligns with the petition
USCIS scrutinizes whether your state medical license and board certification match the specific role in the I-129 petition. If you're filing as a hospitalist but your license lists a different specialty, request a corrected or updated license before your employer submits.
Negotiate premium processing into your employment contract
USCIS premium processing brings an adjudication decision within 15 business days. For physician roles with credentialing timelines and hospital start dates, ask the employer to commit to premium processing in writing before you sign the offer.
H-1B Visa Medical Doctor: Frequently Asked Questions
Do Medical Doctor jobs require entering the H-1B lottery?
Not usually. Most physician positions are at hospitals, academic medical centers, or nonprofit health systems, which are cap-exempt H-1B employers. Cap-exempt employers can file I-129 petitions year-round without entering the annual lottery. If you're joining a private practice that lacks a nonprofit affiliation, that employer may be cap-subject, and lottery timing applies.
Does a foreign medical degree qualify for H-1B specialty occupation?
Yes, provided USCIS confirms the degree is equivalent to a U.S. MD or DO. Foreign-trained physicians also need ECFMG certification before an employer can sponsor them. USCIS may request a credential evaluation from a recognized agency to establish degree equivalency if the petition doesn't include one upfront.
How do I find hospitals and health systems that sponsor H-1B visas for physicians?
Migrate Mate shows verified H-1B LCA filing history by employer and occupation, so you can identify which hospitals, health systems, and academic medical centers have actively sponsored physician roles. That's a faster filter than scanning job boards where sponsorship status is often unlisted or inaccurate.
Can I work as a Medical Doctor during H-1B processing?
If you're changing status from another valid visa and your employer filed before your current status expired, you can often continue working under cap-gap or portability rules depending on your prior status. Physicians on J-1 visas face an additional complexity: the two-year home residency requirement must be waived or fulfilled before an H-1B petition is approvable.
What does the prevailing wage requirement mean for physician H-1B petitions?
Before filing your H-1B petition, your employer must obtain a certified Labor Condition Application confirming your offered wage meets or exceeds the DOL prevailing wage for your specialty and work location. Physician prevailing wages vary significantly by specialty, city, and employer type. Your employer can verify the applicable wage level using the OFLC Wage Search before setting your compensation.
