Verify your NCLEX and credential equivalency early
USCIS requires a bachelor's-level nursing degree for H-1B specialty occupation status. If you hold a three-year international nursing degree, get a credential evaluation from a CGFNS-approved agency before applying so employers aren't surprised during the filing stage.
Target hospitals enrolled in E-Verify
Federal contractors and facilities receiving federal funding must use E-Verify, which signals an established process for employment eligibility verification. These employers typically have immigration infrastructure in place and are more familiar with H-1B filing timelines for clinical roles.
Search LCA filing history on Migrate Mate
Filter by triage or emergency nursing occupation codes to see which hospital systems have certified Labor Condition Applications for RN roles. This tells you which employers have already cleared the DOL filing step, not just those who claim to sponsor.
Check the prevailing wage before negotiating offers
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your occupation and work location. Run your job title and zip code through the OFLC Wage Search before any offer conversation so you know the floor they're legally required to meet.
Clarify cap-subject status before the April lottery
Most hospital and health system positions are cap-subject, meaning your petition enters the annual H-1B lottery. Nonprofit teaching hospitals and certain research hospitals are cap-exempt. Confirming your employer's exemption status before April 1 determines whether you need lottery selection or can file any time.
Request the I-129 filing timeline in writing
Ask your employer's immigration contact for the expected petition filing date and whether premium processing is included. USCIS premium processing guarantees a 15-business-day adjudication decision, which matters if your OPT or current status expires close to your start date.

Find Triage Registered Nurse JobsTriage Registered Nurse H-1B Visa: Frequently Asked Questions
Does a triage registered nurse role qualify as an H-1B specialty occupation?
Yes, triage RN positions qualify as specialty occupations when the employer requires at least a bachelor's degree in nursing as a minimum hiring standard. USCIS looks at whether the degree requirement is standard for the role in the industry, not just at the employer. Most hospital triage positions list a BSN as required, which supports the specialty occupation classification.
Which employers are most likely to sponsor H-1B visas for triage nurses?
Large health systems, academic medical centers, and Level I and II trauma centers file the most LCAs for registered nursing roles. These facilities have dedicated HR and immigration teams familiar with the process. You can browse verified H-1B sponsoring employers with active triage and emergency RN filings on Migrate Mate, filtered by location and occupation code.
How does the H-1B lottery affect my timeline if I'm a triage nurse on OPT?
If your OPT ends before October 1 and your H-1B petition is selected in the lottery, the cap-gap rule extends your work authorization through September 30. Your employer must file by April 1 for the October 1 start date. If your OPT expires well before April, you may need to time your job start or explore a cap-exempt employer to avoid a gap.
What does the Labor Condition Application process mean for my job offer?
Before USCIS can adjudicate your H-1B petition, your employer must file and receive a certified LCA from DOL. The LCA confirms the offered wage meets the prevailing wage for your occupation and work location, and that hiring you won't adversely affect working conditions for U.S. workers. LCA certification typically takes seven business days and must happen before the I-129 is filed.
Can I transfer my H-1B to a new hospital if I change triage nursing jobs?
Yes, H-1B portability under AC21 lets you start working for a new employer as soon as the new I-129 petition is filed, provided your original petition was approved and you've been in valid H-1B status for at least 180 days. The new employer files a fresh petition with a new LCA, and you don't need to wait for USCIS approval to begin work.
