Verify your NP credentials meet specialty occupation
H-1B approval requires your role to demand at least a master's degree in a directly related field. Confirm your MSN or DNP with a psychiatric specialty is documented before your employer files. The O*NET profile for Nurse Practitioners lists the required education level.
Target employers with active LCA filing history
Search Migrate Mate to filter Mental Health Nurse Practitioner roles by employers who have filed Labor Condition Applications for this occupation code. LCA history signals that HR and legal teams already understand the H-1B process for NP roles.
Confirm state licensure before the employer files
Your employer's LCA must list the work state, and USCIS expects you to hold or be actively pursuing licensure there. Some states require a separate psychiatric NP endorsement. Delays in licensure transfer can push your start date past the H-1B effective date.
Ask about cap-exempt employer status early
Federally qualified health centers, nonprofit hospitals affiliated with universities, and government-run psychiatric facilities can file H-1B petitions outside the annual cap. Cap-exempt employers can file year-round, so your start date isn't tied to the October 1 fiscal-year deadline.
Use OFLC Wage Search to validate your offered wage
DOL requires your employer to pay at least the prevailing wage for your SOC code and work location. Run the OFLC Wage Search for Nurse Practitioners in your metro area before accepting an offer. A wage below Level I for your county triggers LCA certification issues.
Prepare for premium processing if your start date is tight
USCIS premium processing expedites the I-129 adjudication to 15 business days. If your current OPT or prior visa status expires soon after your intended start date, ask your employer to budget for premium processing at the time of filing.
H-1B Visa Mental Health Nurse Practitioner: Frequently Asked Questions
Does a Mental Health Nurse Practitioner role qualify as an H-1B specialty occupation?
Yes. The role requires at minimum a master's degree in nursing with a psychiatric or mental health specialty, which satisfies USCIS's specialty occupation standard. Your employer will need to document that the position normally requires this level of education, and your credentials must match the field. A DNP or MSN with a PMHNP concentration is the standard qualifying credential.
How do I find employers who will sponsor an H-1B for this role?
Migrate Mate filters Mental Health Nurse Practitioner listings by employers who have filed Labor Condition Applications for this occupation. That filing history is the clearest signal that an employer has sponsored H-1B workers in this role before and has the legal infrastructure to do it again. Searching by LCA history saves time compared to asking each employer individually.
Can I start working before my H-1B is approved if I'm on OPT?
If you're transitioning from F-1 OPT and your employer filed your H-1B petition before your OPT expired, cap-gap protection extends your work authorization through September 30 of that year. If your H-1B is selected and approved, you can continue working through October 1 and beyond. USCIS issues an updated I-797 that serves as proof of this extended authorization.
Does my state nursing license affect the H-1B filing timeline?
Yes. Your employer's LCA names the state where you'll work, and USCIS expects you to have or be in the process of obtaining licensure there. Some states require a separate psychiatric NP certification beyond the RN license. If your license is pending, your employer can still file the H-1B, but you can't begin practicing until the state board issues the license.
Are there H-1B filing options outside the annual lottery for mental health roles?
Cap-exempt H-1B filings are available through certain employers, including federally qualified health centers, nonprofit psychiatric hospitals affiliated with universities, and government-operated mental health facilities. These employers can file year-round without entering the lottery. Mental health workforce shortages have made these settings active H-1B sponsors, and they're worth targeting specifically if you need to start work outside the April registration window.
