Get Access To All JobsTips for Finding H-1B Visa Sponsorship as a Mental Health Technician
Verify your degree meets specialty occupation
H-1B approval for Mental Health Technician roles hinges on proving the job requires a bachelor's degree in a specific field. Pull the O*NET profile for your occupation code and confirm your degree field matches the listed education requirements before applying.
Target cap-exempt behavioral health employers
Nonprofit hospitals, federally qualified health centers, and university-affiliated psychiatric facilities are cap-exempt, meaning they can file your H-1B petition any time of year without entering the April lottery. Prioritize these employers if your current status has a tight timeline.
Search LCA filing history on Migrate Mate
Filter employers by verified DOL Labor Condition Application filings for behavioral health and mental health roles on Migrate Mate. This shows which facilities have sponsored this occupation before, cutting your outreach list to employers with a documented sponsorship track record.
Request the prevailing wage tier in your offer
Your employer must certify your wage meets the DOL prevailing wage for your location and job level. Use the OFLC Wage Search to look up the Level I through Level IV wage for your SOC code before negotiating, so you can flag underpayment before the LCA is filed.
Disclose licensure requirements to your employer early
Many states require Mental Health Technicians to hold specific certifications or work under licensed supervision. Employers unfamiliar with H-1B specialty occupation rules may not realize that licensing gaps can complicate the petition, so surface credential requirements during the offer stage, not after.
Prepare a credential evaluation before the petition
If your psychology or social work degree is from outside the U.S., get a credential evaluation from a NACES-member evaluator that explicitly confirms U.S. bachelor's equivalency. USCIS frequently issues RFEs on foreign degrees in behavioral health fields when equivalency isn't documented upfront.

Find Mental Health Technician JobsMental Health Technician H-1B Visa: Frequently Asked Questions
Does a Mental Health Technician role qualify as a specialty occupation for H-1B purposes?
It depends on how the employer defines the position. USCIS requires that the role normally requires at least a bachelor's degree in a specific field such as psychology, social work, or counseling. Roles that accept any bachelor's degree or substitute years of experience for a degree can fail the specialty occupation test. Your employer's job description and the O*NET classification for the SOC code both factor into the adjudication.
Which types of employers sponsor H-1B visas for Mental Health Technicians?
Behavioral health hospitals, inpatient psychiatric units, residential treatment centers, and community mental health centers are the most common sponsors. Nonprofit health systems and university-affiliated facilities are often cap-exempt, letting them file outside the April lottery window. Use Migrate Mate to search employers with active LCA filing history in behavioral health occupations, which narrows your outreach to organizations that have already committed to H-1B sponsorship for this role type.
How does the H-1B cap lottery affect Mental Health Technician applicants?
Cap-subject employers must register you in the USCIS electronic registration window, typically open in March, for the fiscal year starting October 1. Selection is random. If you're not selected, cap-exempt employers, including nonprofits affiliated with a university or hospital system, can file for you at any point during the year. Timing your job search toward cap-exempt facilities reduces your dependence on lottery selection.
What happens to my H-1B status if my mental health employer loses funding or closes a program?
If your employer terminates your H-1B before the petition end date, you have a 60-day grace period to find a new sponsor, change status, or depart the U.S. Your new employer must file an H-1B transfer petition, which can be done concurrently with you starting work if the petition is filed before your grace period expires. Behavioral health funding gaps are common, so confirming an employer's financial stability before accepting an offer matters.
Can a foreign psychology degree support an H-1B petition for a Mental Health Technician role?
Yes, but you need a credential evaluation from a NACES-member organization that confirms the degree is equivalent to a U.S. bachelor's in a directly related field. USCIS reviews the specific field of study, not just degree level, and frequently issues Requests for Evidence when behavioral health degrees from foreign institutions lack a detailed course-by-course evaluation. Submit this evaluation with the initial I-129 petition rather than waiting for an RFE.
