Get Access To All JobsTips for Finding H-1B Visa Sponsorship as a Clinical Assistant
Verify your degree meets specialty occupation
USCIS requires Clinical Assistant roles to mandate a specific bachelor's degree, not just prefer one. Review the O*NET profile for this occupation to confirm the degree requirement language before applying.
Target employers with LCA filing history
Search Migrate Mate to filter Clinical Assistant openings by employers with verified H-1B Labor Condition Application filings, so you're only applying to organizations that have actively sponsored this role category.
Check E-Verify enrollment before accepting offers
STEM OPT extensions require E-Verify enrollment, and many clinical employers haven't registered. Confirm E-Verify status during the offer stage, not after signing, to avoid losing OPT authorization.
Use OFLC Wage Search to negotiate salary
Your employer's LCA must certify wages at or above the DOL prevailing wage for your job title and location. Run the OFLC Wage Search for SOC code 31-9092 before negotiating so you know the floor.
Ask about cap-exempt employer status early
Hospitals affiliated with universities or nonprofits engaged in research may qualify as cap-exempt H-1B employers, letting you start work outside the annual lottery window. Clarify this during the interview, not after the offer.
Document clinical scope of work for the I-129
USCIS RFEs on Clinical Assistant petitions often challenge whether the duties require a degree-level hire. Get a written role description from your employer that maps each duty to a specific academic discipline before the I-129 is filed.
H-1B Visa Clinical Assistant: Frequently Asked Questions
Does a Clinical Assistant role qualify as a specialty occupation for H-1B purposes?
It can, but it's not automatic. USCIS requires the position to normally require a bachelor's degree in a specific field such as health sciences, biology, or a related discipline. If the job description accepts any bachelor's degree or lists the degree as preferred rather than required, the petition is more likely to face an RFE. The O*NET profile for this occupation supports a specialty occupation argument when the duties are clinically specific.
Which types of employers sponsor H-1B visas for Clinical Assistant positions?
Academic medical centers, hospital systems, and outpatient specialty clinics are the most consistent sponsors for Clinical Assistant roles. University-affiliated hospitals are particularly valuable because they may qualify as cap-exempt H-1B employers, meaning you can start without waiting for the April lottery. You can browse verified sponsoring employers on Migrate Mate, filtered specifically for this role.
What happens to my H-1B status if my clinical employer loses its hospital accreditation or closes a department?
Your H-1B status is tied to the specific employer and worksite listed on your I-129 petition. If the department closes or the employer loses accreditation, your authorized status ends with that employment. You have a 60-day grace period to find a new H-1B sponsor, change status, or depart. The new employer must file a new I-129 before you begin work.
Can my H-1B be sponsored for part-time Clinical Assistant work?
Yes, H-1B status is available for part-time positions, but the LCA must reflect the actual part-time hours and the prevailing wage must be prorated accordingly. Some employers are reluctant to sponsor part-time roles due to the filing cost relative to hours worked, so this is worth clarifying before the offer stage rather than assuming full sponsorship is available.
How do I find Clinical Assistant jobs where the employer is already familiar with H-1B filing?
Employer familiarity with H-1B filing matters because inexperienced employers often withdraw offers when they learn about LCA certification, attorney fees, or the lottery. Filtering by employers with documented LCA filing history is the most reliable way to avoid this. Migrate Mate surfaces Clinical Assistant openings tied to employers with verified H-1B filing records, so you're not discovering sponsorship hesitancy after an offer is extended.
