Verify your degree meets specialty occupation
USCIS requires a direct relationship between your degree field and the Operations Director role. A general business degree usually qualifies, but a degree in an unrelated field will trigger an RFE. Gather transcripts and have equivalency evaluations ready before applying.
Filter employers by LCA filing history
Use Migrate Mate to identify companies that have actively filed LCAs for Operations Director or similar management titles. This filters out employers who express interest in sponsorship but have no documented filing history with DOL.
Target cap-exempt employers to skip the lottery
Universities, nonprofit research organizations, and government-affiliated entities are cap-exempt. Operations Directors at these organizations can be sponsored outside the annual H-1B lottery, giving you a filing window any time of year.
Check prevailing wage before salary negotiations
Look up the Level III or IV wage for SOC code 11-1021 in your metro area using the OFLC Wage Search before you negotiate. Your offered salary must meet or exceed the certified LCA wage, so knowing the floor strengthens your negotiating position.
Request premium processing in your offer negotiation
USCIS premium processing reduces the I-129 adjudication window to 15 business days. Negotiate for the employer to elect premium processing at the time of filing, not after delays arise, since adding it later extends your uncertainty period.
Build a specialty occupation evidence file early
Operations Director petitions face heightened scrutiny because the title sounds generalist. Collect job postings from your target employers, your O*NET occupation profile, and any industry certifications that tie your specific duties to a specialized degree requirement.
H-1B Visa Operations Director: Frequently Asked Questions
Does an Operations Director role qualify as a specialty occupation for H-1B purposes?
Yes, if the position normally requires a bachelor's degree or higher in a specific field such as business administration, industrial engineering, or supply chain management. Roles where any degree field is acceptable, or where experience substitutes freely for education, are harder to support. Your employer's internal job description and industry norms both factor into USCIS's assessment.
How do I find employers who have actually sponsored H-1B visas for Operations Directors?
Migrate Mate shows verified DOL Labor Condition Application filing history by occupation, so you can see which companies have filed for Operations Director or closely related management titles. This is more reliable than asking during interviews, since many employers express willingness to sponsor without having ever completed the process.
What happens to my H-1B status if my Operations Director role is eliminated or restructured?
Your H-1B is tied to the specific employer and position on the approved petition. If the role is eliminated, you have a 60-day grace period to find a new sponsoring employer, transfer your H-1B, or change status. If your duties change substantially, your employer should file an amended I-129 before the change takes effect to avoid a status violation.
Can my employer transfer the H-1B petition if I move into a more senior operations role?
A promotion to a materially different title, such as Chief Operating Officer or VP of Operations, typically requires an amended or new H-1B petition rather than a simple update. USCIS treats significant changes in duties, supervisory scope, or SOC code as a new specialty occupation determination. Your employer should file before the promotion takes effect.
Is it possible to get H-1B sponsorship for an Operations Director role at a startup?
Yes, but startups face additional scrutiny because USCIS may question whether a small company genuinely needs a specialty occupation professional at the director level. A strong offer letter detailing specific technical or analytical duties, an organizational chart showing the reporting structure, and evidence of operational complexity in the business all strengthen the petition.
