Verify your fellowship counts toward specialty occupation
Your pediatric cardiology fellowship is the credential that anchors the specialty occupation argument. Confirm your training institution issued documentation showing the subspecialty requirement, since USCIS scrutinizes whether the role requires that specific degree pathway.
Target cap-exempt hospital systems first
Nonprofit children's hospitals and university-affiliated medical centers are cap-exempt under INA, so they can file your H-1B petition any time of year without lottery risk. Prioritize these employers before considering for-profit health systems.
Search verified sponsors on Migrate Mate
Use Migrate Mate to filter pediatric cardiology roles by employers with confirmed H-1B LCA filing history, so you only pursue positions at organizations that have actually sponsored this occupation before.
Pull the prevailing wage before negotiating your offer
Run your job title and practice location through the OFLC Wage Search before you receive an offer. Your employer's LCA must certify a wage at or above the DOL prevailing wage for your geographic area and experience level.
Ask about concurrent H-1B filing during credentialing
Hospital credentialing for pediatric cardiologists typically takes 90 to 120 days. Confirm with your employer that I-129 preparation starts in parallel, not after credentialing clears, to avoid a gap between your OPT or J-1 visa end date and H-1B approval.
Clarify J-1 waiver status before H-1B filing begins
If you completed your fellowship on a J-1 visa, the two-year home residency requirement blocks H-1B status unless you've obtained a Conrad 30 waiver or other J-1 waiver. Confirm your waiver approval letter is on file before your employer submits the I-129.
H-1B Visa Pediatric Cardiologist: Frequently Asked Questions
Does a pediatric cardiologist role qualify as a specialty occupation for H-1B purposes?
Yes. Pediatric cardiology requires a Doctor of Medicine or Doctor of Osteopathic Medicine degree followed by a pediatrics residency and a subspecialty fellowship in pediatric cardiology. That degree-specific training pathway satisfies USCIS's specialty occupation definition, which requires a minimum of a bachelor's degree or its equivalent in a directly related field.
Are most children's hospitals cap-exempt for H-1B petitions?
Most nonprofit children's hospitals and university-affiliated academic medical centers qualify as cap-exempt employers under the H-1B statute, meaning they're not subject to the 65,000 regular cap or the 20,000 U.S. master's cap. They can file petitions at any point in the fiscal year. For-profit pediatric practices and private equity-owned groups are generally cap-subject and require lottery selection.
How does a J-1 waiver affect my timeline for getting H-1B sponsorship?
If you trained on a J-1 exchange visitor visa, the two-year home country physical presence requirement applies unless waived. A Conrad 30 waiver through a state health agency is the most common path for physicians. Your H-1B petition can't be approved until the waiver is granted, so your employer needs to build that lead time into the filing schedule.
What should I look for in an employer to assess their H-1B sponsorship track record?
Check whether the employer has filed Labor Condition Applications for pediatric cardiology or related physician roles in recent years. DOL LCA disclosure data is public and shows the occupation codes, wage levels, and worksites an employer has certified. Migrate Mate surfaces this filing history by employer so you can evaluate sponsorship patterns before investing time in an application process.
Can my H-1B petition be filed while I'm still completing my fellowship?
Yes. If your fellowship ends on June 30, your employer can file your H-1B cap-subject petition in April and request an October 1 start date, with cap-gap protection bridging the gap if you're on OPT. For cap-exempt employers like nonprofit hospitals, the petition can be filed and approved before your fellowship ends with a future start date.
