Verify your credentials meet ECFMG standards
USCIS requires foreign medical graduates to hold ECFMG certification before practicing in the U.S. Confirm your certification is current and matches the specialty your employer will list on the I-129 petition before any offer advances to filing.
Target cap-exempt hospitals and academic centers
Nonprofit hospitals, university health systems, and federally qualified health centers are cap-exempt, meaning your employer can file any time without entering the lottery. This dramatically shortens your path from offer to work authorization.
Check prevailing wage before negotiating your offer
Use the OFLC Wage Search to look up the prevailing wage for your specialty and county before you accept an offer. Your employer's LCA must certify a wage at or above that level, so knowing the floor protects you in salary discussions.
Search verified H-1B employers on Migrate Mate
Filter by specialty, location, and DOL LCA filing history on Migrate Mate to identify hospital systems and group practices with a documented record of sponsoring physician roles, so you're not guessing which employers will actually support your petition.
Clarify state licensure timing with your employer
H-1B petitions for physicians list a specific state of employment, and many states require a full medical license before USCIS will approve the petition. Confirm whether your employer will accept a training permit or limited license during the interim period.
Request premium processing when timelines are tight
If your OPT or prior status is expiring, ask your employer to file with USCIS premium processing, which guarantees a decision within 15 business days. Cap-exempt employers can file at any point, so there's no reason to wait on a standard timeline when your status is at risk.
H-1B Visa Physician: Frequently Asked Questions
Do Physician roles qualify for H-1B sponsorship?
Yes. Physician positions qualify as specialty occupations because they require at minimum a Doctor of Medicine or Doctor of Osteopathy degree in a directly related field. USCIS treats the degree requirement as inherent to the occupation, so the specialty occupation standard is straightforward to meet compared with roles where the degree connection is disputed.
Which employers can sponsor an H-1B for a physician without a lottery?
Nonprofit hospitals, academic medical centers, university-affiliated health systems, Veterans Affairs facilities, and federally qualified health centers are cap-exempt. That means they can file your H-1B petition at any point in the year without entering the annual lottery. Use Migrate Mate to search employers with verified LCA filing history in your specialty and target state.
Does an H-1B physician need a full state medical license before filing?
It depends on the state. Some states accept a training permit or limited license for the duration of the petition, while others require a full unrestricted license before USCIS will approve. Your employer's immigration attorney should confirm the licensure requirement for your specific state before submitting the I-129, since an approval can be conditioned on licensure status.
Can a physician on J-1 status switch to H-1B?
Yes, but J-1 visa physicians who completed graduate medical education typically carry a two-year home residence requirement. You'll need either a J-1 waiver granted through a Conrad 30 state program, a federal agency, or a hardship or persecution claim before USCIS will approve an H-1B change of status. Conrad 30 waivers require a commitment to work in a medically underserved area for at least three years.
How does the H-1B prevailing wage requirement affect physician compensation?
Before filing the LCA with DOL, your employer must certify that your offered wage meets or exceeds the prevailing wage for your specialty and work location. The prevailing wage is determined by DOL's wage levels for the relevant Standard Occupational Classification code. Use the OFLC Wage Search to look up the wage floor for your specialty before finalizing your offer, since an LCA that certifies below the actual prevailing wage can jeopardize your petition.
