Verify your credentials meet ECFMG requirements
International medical graduates must hold ECFMG certification before a U.S. employer can file your H-1B petition. Confirm your medical degree, postgraduate training, and USMLE steps are fully documented before approaching employers, since missing credentials stall the filing timeline.
Target cap-exempt hospital systems first
Nonprofits affiliated with universities or research institutions are cap-exempt, meaning your H-1B petition bypasses the annual lottery. Academic medical centers and VA-affiliated hospitals often fall into this category, giving you year-round filing eligibility rather than a single April window.
Search verified H-1B sponsors on Migrate Mate
Use Migrate Mate to filter Staff Psychiatrist openings by employers with active H-1B LCA filing history. That DOL Labor Condition Application data tells you which health systems have actually filed for psychiatry roles, not just which ones claim to sponsor.
Confirm prevailing wage tier before negotiating
Your employer's LCA must certify your salary meets the DOL prevailing wage for your metro area and experience level. Run the OFLC Wage Search using the correct SOC code for psychiatrists to know which wage tier applies before you enter any offer discussion.
Ask employers about concurrent H-1B and green card filing
Psychiatric workforce shortages in many regions make physicians strong EB-2 or EB-3 green card candidates. Ask prospective employers whether they initiate PERM labor certification concurrently with H-1B sponsorship, since some hospital systems have established timelines for physician permanent residency.
Clarify state medical license timing with your employer
USCIS requires you to hold a valid state medical license, or show you meet all licensing requirements, at the time of filing. Confirm with your employer which state license they need and who covers the licensing fees, since delays there directly delay your petition.

Find Staff Psychiatrist JobsStaff Psychiatrist H-1B Visa: Frequently Asked Questions
Does a Staff Psychiatrist role qualify as an H-1B specialty occupation?
Yes. Psychiatry requires at minimum a Doctor of Medicine or Doctor of Osteopathic Medicine degree plus completion of a psychiatric residency, meeting the USCIS definition of a specialty occupation. Both outpatient clinic positions and inpatient hospital roles qualify. The complexity of psychiatric diagnosis and treatment is well-documented in the O*NET occupation profile for psychiatrists.
Which types of employers sponsor H-1B visas for Staff Psychiatrists?
Academic medical centers, nonprofit health systems, VA-affiliated hospitals, federally qualified health centers, and large telehealth groups are the most active H-1B sponsors for psychiatrists. Many of these are cap-exempt institutions, meaning they can file your petition at any point in the year without waiting for the April lottery window. Migrate Mate shows verified LCA filing history so you can identify which employers have actually sponsored psychiatry roles.
Can my H-1B petition be filed if I don't yet have a state medical license?
USCIS allows filing if you meet all licensing requirements but haven't yet received the physical license, provided your employer documents eligibility thoroughly. Some states issue training licenses or temporary permits that satisfy the requirement at the time of filing. Your employer's immigration counsel typically handles this documentation, but you should confirm the specific state's process early in the offer stage.
How does the H-1B cap lottery affect psychiatrists seeking sponsorship?
If your prospective employer is a for-profit private practice or non-qualifying commercial telehealth company, your petition enters the annual lottery capped at 85,000 visas. If your employer is a nonprofit hospital, university-affiliated health system, or government research facility, the cap-exemption applies and your petition can be filed and approved any time during the year, bypassing lottery risk entirely.
What does the DOL prevailing wage requirement mean for a Staff Psychiatrist H-1B petition?
Before USCIS approves your H-1B, your employer must file an LCA with the DOL certifying your offered salary meets the prevailing wage for your occupation and work location. The wage level depends on your experience and job duties, ranging from entry-level to fully proficient tiers. Use the OFLC Wage Search with the psychiatrists SOC code to verify which tier applies to your specific role and metro area before accepting an offer.
