Map your degree to the role
USCIS requires your degree field to directly relate to Program Supervisor duties. A social work or public administration degree maps cleanly, but a general business degree may need a detailed credential evaluation letter from a NACES-member evaluator to survive an RFE.
Target LCA-active employers in your sector
Pull the OFLC Wage Search to confirm which employers have certified LCAs for Program Supervisor or related SOC codes in your target location. Government contractors and federally funded nonprofits file consistently and are worth prioritizing in your search on Migrate Mate.
Verify the specialty occupation argument early
Program Supervisor sits in a gray zone for USCIS specialty occupation review. Confirm the job posting requires a specific bachelor's degree field, not just any degree. A generic 'bachelor's preferred' posting weakens the H-1B petition and invites an RFE.
Negotiate filing fees into your offer
USCIS filing fees for the I-129 are legally the employer's responsibility and cannot be passed to you. Raise this in the offer stage, not after signing, so both sides understand who covers premium processing if timelines are tight.
Check O*NET before your interview
Review the O*NET occupation profile for Program Supervisor to internalize the official duties and required knowledge areas. Interviewers at H-1B-sponsoring employers often assess whether your background aligns with the DOL-defined role, which directly affects how they structure the LCA.
File early if your status is expiring
If you're transitioning from OPT or another status, your employer must file the I-129 with enough lead time to avoid a gap. USCIS recommends filing at least six months before your authorized stay ends, and premium processing can cut the adjudication window to roughly 15 business days.
H-1B Visa Program Supervisor: Frequently Asked Questions
Does a Program Supervisor role qualify as a specialty occupation for H-1B purposes?
It depends on how the employer defines the position. USCIS requires that the job normally requires a bachelor's degree in a specific field, not just any degree. A Program Supervisor role in healthcare administration, social services, or public policy typically qualifies when the job description ties duties to a specific discipline. Vague postings that accept any bachelor's degree are the most common reason petitions for this title face RFEs.
Which industries sponsor H-1B visas most often for Program Supervisor positions?
Government contractors, federally funded nonprofits, healthcare systems, and public health organizations file LCAs for Program Supervisor roles with regularity. These employers operate under compliance frameworks that make structured H-1B sponsorship a normal part of hiring. You can filter by industry and verified LCA history on Migrate Mate to focus your applications on employers already set up to sponsor.
Can my employer file an H-1B for a Program Supervisor role if I have a three-year bachelor's degree?
A three-year degree from certain countries, particularly India and Australia, can satisfy the U.S. bachelor's equivalency requirement, but it's not automatic. USCIS evaluates whether the degree is equivalent to a U.S. four-year bachelor's in the relevant field. A credential evaluation from a NACES-recognized agency documenting the equivalency is standard practice and should be prepared before the employer files the I-129.
What happens to my H-1B if my Program Supervisor role is restructured or my title changes?
A material change in job duties, location, or reporting structure typically requires your employer to file an amended H-1B petition before the change takes effect. A title change alone may not trigger an amendment, but if the core duties shift significantly, USCIS expects a new filing. Staying in the same metro area with similar duties generally does not require a new LCA, but a site change to a different city does.
How does prevailing wage work for Program Supervisor H-1B petitions?
Your employer must certify through the DOL Labor Condition Application that your salary meets or exceeds the prevailing wage for the Program Supervisor SOC code in your specific work location. Prevailing wage is set at either Level I, II, III, or IV depending on your experience and the role's complexity. You can look up the applicable wage tier using the OFLC Wage Search before negotiations to confirm the offer is LCA-compliant.
