Verify your license transfers across states
H-1B approval for psychotherapists depends on holding a valid state license in the employer's location. Confirm reciprocity rules before applying, since transferring licensure can take months and delay your petition start date.
Target employers with FQHC or CMHC status
Federally Qualified Health Centers and community mental health centers are cap-exempt H-1B employers. Applying through these organizations means no lottery, faster processing, and year-round petition filing regardless of the April registration window.
Search H-1B psychotherapist filings on Migrate Mate
Filter by SOC code 19-3034 on Migrate Mate to see which employers have filed LCAs for psychotherapist roles. This shows you verified sponsors before you apply, cutting time spent on employers who don't sponsor.
Confirm the prevailing wage tier before negotiating
Use the OFLC Wage Search to look up the prevailing wage for your SOC code and work location before salary discussions. Your employer's LCA must certify a wage at or above that level, so knowing the floor protects you.
Document supervised hours for credential verification
Many psychotherapist H-1B petitions require evidence of supervised clinical hours to establish specialty occupation. Gather official letters from supervisors and practicum coordinators now, since missing documentation is a leading cause of RFEs in mental health roles.

Find Psychotherapist JobsPsychotherapist H-1B Visa: Frequently Asked Questions
Does a psychotherapist role qualify as a specialty occupation for H-1B purposes?
Yes. Psychotherapist positions require at minimum a master's degree in a specific field such as clinical psychology, counseling, or social work, which meets the specialty occupation standard under USCIS rules. You'll need to document that the employer's job description requires this specific degree, not just any bachelor's degree in a general field.
Which types of employers commonly sponsor H-1B visas for psychotherapists?
Hospitals, university counseling centers, Federally Qualified Health Centers, Veterans Affairs facilities, and large group practices are the most active H-1B sponsors for psychotherapist roles. VA facilities and FQHCs are cap-exempt, meaning they can file petitions outside the standard lottery. You can find employers with verified H-1B filing history for mental health roles on Migrate Mate.
Does state licensure affect my H-1B petition as a psychotherapist?
It does. USCIS expects psychotherapists to hold the appropriate state license for the work location. If your license is in a different state than the job, the petition can be issued with conditions or face an RFE. Start the licensure transfer process as early as possible, since some states take three to six months to process applications.
Can a psychotherapist work at multiple clinic sites under one H-1B petition?
Yes, but each worksite requires a separate certified LCA. Your employer must file an amended H-1B petition with USCIS if you add a new primary worksite not covered by the original filing. Short-term placements at client sites under certain DOL conditions may be exempt, but a recurring second location requires its own documentation.
What happens to my H-1B status if I change employers between clinical roles?
You can begin working for a new H-1B sponsor as soon as the new employer files a petition with USCIS, under portability rules that apply once your current H-1B has been approved for at least 365 days. Your status doesn't lapse during the transfer, but the new employer must file before your current authorized period ends.
