Verify your degree meets specialty occupation
Behavioral Health Tech roles vary widely. Before applying, confirm the posting requires a bachelor's degree in a directly related field like psychology or counseling. Roles where any degree is accepted won't qualify as a specialty occupation under USCIS standards.
Pull LCA filings to identify active sponsors
Search the OFLC Wage Search for Labor Condition Applications filed under SOC code 21-1018 or 29-2099. Employers with recent certified LCAs have already cleared the DOL wage compliance step and are actively hiring H-1B workers in behavioral health roles.
Target facilities with cap-exempt status
Nonprofit mental health centers affiliated with universities or government research institutions may qualify as cap-exempt H-1B employers. A cap-exempt sponsor can file your petition any time of year, removing lottery risk entirely from your job search.
Use Migrate Mate to filter verified H-1B sponsors
Search Migrate Mate to find Behavioral Health Tech employers with confirmed H-1B filing history. You'll see which facilities have sponsored this specific role, so you're not sending applications to employers who've never filed a behavioral health petition.
Get your offer letter before the March registration window
USCIS opens H-1B lottery registration in early March for an October 1 start date. Your employer needs a signed offer letter to register you. Start active interviews no later than January so you're not scrambling after the window opens.
Confirm your employer is E-Verify enrolled before accepting
H-1B employers are legally required to participate in E-Verify. Before accepting an offer, ask HR to confirm enrollment. An employer who hasn't enrolled can't lawfully file your H-1B petition, and discovering this after signing wastes your application cycle.
H-1B Visa Behavioral Health Tech: Frequently Asked Questions
Does a Behavioral Health Tech job qualify as a specialty occupation for H-1B purposes?
It depends on how the employer defines the role. USCIS requires the position to normally demand a bachelor's degree in a specific field like psychology, counseling, or social work. Roles where the employer accepts any bachelor's degree, or substitutes experience for a degree, are harder to defend as specialty occupations. Review the job description carefully before applying, and look for postings that list a specific required field of study.
Which types of employers sponsor H-1B visas for Behavioral Health Techs?
Inpatient psychiatric hospitals, community mental health centers, residential treatment facilities, and large integrated health systems are the most active H-1B sponsors for this role. Nonprofit and government-affiliated mental health organizations may also qualify as cap-exempt employers, which means they can file H-1B petitions outside the annual lottery. Use Migrate Mate to browse facilities with verified H-1B filing history specific to behavioral health positions.
What prevailing wage level applies to Behavioral Health Tech H-1B petitions?
Most entry-level Behavioral Health Tech petitions are filed at DOL wage Level I or Level II, reflecting positions requiring limited experience and close supervision. Your employer sets the offered wage at or above the prevailing wage for your metro area, as determined by the OFLC Wage Search under the applicable SOC code. Wages vary significantly by geography, so the prevailing wage in a rural county will differ from a major metro area.
Can I switch from OPT to H-1B status while working as a Behavioral Health Tech?
Yes. If your employer files your H-1B petition during the March registration window and you're selected in the lottery, your status transitions to H-1B on October 1. If you're on STEM OPT, your authorization continues through that date under cap-gap rules. The key requirement is that your employer submits the petition before your OPT expires and no later than the filing period USCIS designates after lottery selection.
How do I know if a Behavioral Health Tech employer will actually file my H-1B petition?
Ask the employer directly whether they've sponsored H-1B workers in behavioral health roles before, and whether they use in-house immigration counsel or an outside law firm. Employers new to H-1B sponsorship sometimes underestimate the cost and timeline. Checking DOL LCA disclosure data for recent certified applications under the employer's name gives you independent confirmation of their actual filing history before you invest time in the interview process.
