Align your portfolio to specialty occupation standards
USCIS evaluates whether your role requires a specific degree, not just design skill. Structure your portfolio to show systems thinking, research methodology, and domain expertise that maps to a bachelor's-level design or HCI discipline.
Search LCA filings for design-role sponsors
Use the OFLC Wage Search to filter Labor Condition Applications by occupation code 15-1255 or 27-1021. Employers who have filed LCAs for Senior Product Design roles have already cleared DOL's prevailing wage process and are operationally ready to sponsor.
Target E-Verify enrolled employers early
STEM OPT extensions require E-Verify enrollment, but so does any company serious about compliant hiring. Confirming E-Verify status before your first interview screens out employers whose HR infrastructure can't support an H-1B petition.
Use Migrate Mate to filter verified H-1B sponsors
Search Senior Product Design roles on Migrate Mate, which surfaces employers with verified LCA filing history by occupation code. That filters your job search to companies that have already navigated DOL's prevailing wage certification for design roles.
Negotiate title and SOC code before the LCA
Your H-1B petition is tied to a specific Standard Occupational Classification code. Ask your employer which SOC code they plan to file under before the LCA is submitted. A mismatch between your actual duties and the filed code is a common RFE trigger.
Prepare for the 60-day grace period if you're between roles
H-1B holders get a 60-day grace period after losing employment. If you're job-searching mid-status, you need an H-1B transfer filed, not just an offer letter, before that window closes. Start the transfer process as soon as you have a written offer.
H-1B Visa Senior Product Design: Frequently Asked Questions
Does Senior Product Design qualify as a specialty occupation for H-1B purposes?
Yes, Senior Product Design qualifies as a specialty occupation when the role requires a bachelor's degree or higher in a directly related field such as graphic design, human-computer interaction, industrial design, or cognitive science. USCIS looks at whether the degree requirement is standard across the industry for that role, not just whether your employer lists it. Roles blending design leadership with systems or research methodology have a stronger foundation for approval than generalist creative positions.
How do I find employers who actively sponsor H-1B visas for product design roles?
Search for employers with verified H-1B Labor Condition Application filings for design-specific occupation codes on Migrate Mate. LCA filings are public record and show which companies have certified prevailing wages for roles matching Senior Product Design. This filters your job search to employers who have already completed DOL's wage compliance process, not just those who say they're open to sponsorship.
What happens to my H-1B if I'm switching from one product design role to another at a new company?
A job change requires an H-1B transfer, which means your new employer files a fresh I-129 petition with USCIS before your last day at the current company. Under AC21 portability, you can start the new role once the transfer petition is filed, not after approval, as long as your current H-1B has been approved for at least 180 days. Confirm the SOC code and LCA are filed correctly before you resign.
Can my employer switch my title from Product Designer to Senior Product Designer without refiling my H-1B?
A title promotion that comes with a material change in duties, pay level, or work location typically requires an amended H-1B petition and a new LCA. If your responsibilities and wage level change substantially, USCIS expects an amendment. Cosmetic title upgrades with no duty change are lower risk, but your employer's immigration counsel should confirm whether an amendment is required before the promotion takes effect.
What wage level should I expect an employer to file for a Senior Product Design H-1B?
The DOL requires employers to pay at least the prevailing wage for your occupation code, work location, and experience level. Senior roles are typically filed at wage level III or IV under the OFLC Wage Search, which reflects experienced or fully competent workers. Filing at too low a wage level is a common RFE trigger, so you can cross-check your offered salary against the DOL wage data before accepting an offer.
