Get Access To All JobsTips for Finding H-1B Visa Sponsorship as a Software Developer
Align your degree to your exact role
USCIS scrutinizes whether your specific degree field matches the Software Developer position. A computer science or software engineering degree maps cleanly, but an information systems or math degree may require a detailed specialty occupation argument in your I-129 filing.
Check employer LCA history before applying
Search the OFLC Wage Search to see whether a company has certified LCAs for Software Developer roles under SOC code 15-1252. Employers with recent, repeated filings are already familiar with the sponsorship process and less likely to back out after an offer.
Target cap-exempt employers to skip the lottery
Universities, nonprofit research organizations, and government research institutions are H-1B cap-exempt, meaning you can start any time of year without entering the March lottery. Software Developer roles at these employers follow the same specialty occupation rules but aren't subject to the 85,000-cap constraint.
Request premium processing when timelines are tight
If your OPT expires before October 1 and cap-gap protection doesn't cover your start date, ask your employer to file premium processing with USCIS for a 15-business-day adjudication decision rather than waiting several months for standard processing.
Use Migrate Mate to filter for verified H-1B sponsors
Search Software Developer roles on Migrate Mate to filter companies by confirmed H-1B LCA filing history. This removes employers who list "visa sponsorship available" without ever having filed, saving you from offers that stall at the legal review stage.
Verify your job description meets specialty occupation standards
Before countersigning an offer letter, confirm the role description explicitly requires a bachelor's degree in a specific technical field. Generic postings that say "degree preferred" or "or equivalent experience" can trigger an RFE from USCIS challenging whether the position qualifies as a specialty occupation.
H-1B Visa Software Developer: Frequently Asked Questions
Does a Software Developer role automatically qualify as an H-1B specialty occupation?
Not automatically. USCIS evaluates each petition individually. The role must require at least a bachelor's degree in a directly related field like computer science or software engineering. Vague job descriptions or postings that accept any degree can draw a Request for Evidence. Your employer's attorney should tie the specific duties to the degree requirement in the I-129 supporting documentation.
Can I switch Software Developer jobs while on H-1B status?
Yes, under H-1B portability rules you can start a new Software Developer position once your new employer files an I-129 petition, as long as your previous H-1B was approved and you've been in valid status for at least 180 days. You don't need to wait for the new petition to be approved before starting. The new employer must still file a fresh LCA with DOL.
What happens to my H-1B if I'm laid off from my Software Developer role?
You enter a 60-day grace period during which you can find a new employer willing to file an H-1B transfer petition. If a new employer files before the 60 days expire, you can stay in status while USCIS adjudicates. Use that window to search Migrate Mate for Software Developer roles at companies with confirmed H-1B sponsorship history to avoid offers that won't move fast enough.
Does the SOC code on my LCA matter for Software Developer positions?
Yes. The SOC code your employer selects determines the prevailing wage level DOL requires them to pay. Software Developer roles typically fall under SOC 15-1252, but employers sometimes file under adjacent codes like 15-1299. A mismatch between your actual duties and the selected SOC code can create compliance issues during a DOL audit or an RFE from USCIS.
Do all Software Developer employers sponsor H-1B visas?
No. Many companies, particularly smaller startups, have never filed an LCA or sponsored a petition. Sponsorship willingness varies widely even among large tech firms depending on the role, location, and internal legal bandwidth. Filtering by verified LCA filing history, rather than relying on self-reported sponsorship claims in job postings, is the most reliable way to identify genuine sponsors before you invest time in the interview process.
