Verify your state licensure transfers
Teaching licenses are state-specific, and USCIS expects your credentials to match the role. Confirm your home-country qualifications have been evaluated for U.S. equivalency before you apply to positions in a target state.
Target cap-exempt school districts first
Public school districts and nonprofit educational institutions are cap-exempt H-1B employers. You skip the annual lottery entirely, so filings can happen year-round. Prioritize these over private or for-profit employers to avoid the April cap season.
Search LCA filings by occupation code
Use Migrate Mate to filter employers by the Special Education Teacher SOC code so you see which districts have active H-1B Labor Condition Applications. That filing history signals genuine sponsorship capacity, not just a willingness to consider it.
Align your IEP experience with prevailing wage levels
DOL sets prevailing wages by experience level for your occupation. Document your years working with Individualized Education Programs, specific disability categories, and caseload size so employers can justify the appropriate wage level in their LCA submission to DOL.
Confirm specialty occupation status with your offer letter
Your offer letter should specify that the role requires a degree in special education or a directly related field, not just a generic bachelor's. USCIS scrutinizes teaching roles, so ambiguous language in the letter can trigger a Request for Evidence.
Ask about the I-129 filing timeline before accepting
School year start dates are fixed, and H-1B processing takes time. Confirm whether the district will file with premium processing and what their HR department's timeline is so your authorization is in place before your first day.

Find Special Education Teacher JobsSpecial Education Teacher H-1B Visa: Frequently Asked Questions
Do Special Education Teacher jobs qualify for H-1B sponsorship?
Yes. Special education teaching qualifies as a specialty occupation because the role typically requires at least a bachelor's degree in special education, learning disabilities, or a closely related field. USCIS expects the employer's job description to specify that degree requirement explicitly. Roles listed as requiring any bachelor's degree regardless of field are at higher risk of an H-1B denial.
Are public school districts cap-exempt for H-1B filings?
Public primary and secondary schools are generally cap-exempt because they qualify as nonprofit educational institutions associated with accredited universities or as governmental research organizations. That means the district can file your H-1B petition at any time during the year without waiting for the April lottery. Private for-profit tutoring companies and some charter schools may not share this exemption, so confirm the employer's status before assuming you're outside the cap.
How do I find school districts that actively sponsor H-1B visas?
LCA disclosure data from the DOL shows which school districts have filed Labor Condition Applications for Special Education Teacher roles by SOC code and location. Migrate Mate surfaces this filing history so you can identify districts with a real track record of H-1B sponsorship rather than relying on job postings alone, which rarely mention immigration support explicitly.
Does my foreign teaching credential meet USCIS specialty occupation standards?
USCIS requires that your foreign degree be evaluated as equivalent to a U.S. bachelor's degree in special education or a closely related field by a credentials evaluation agency. A three-year degree from some countries may not automatically qualify without supplemental coursework. Get a credential evaluation done before applying, and confirm your state's licensing board will accept the equivalent before an employer files on your behalf.
Can a school district sponsor me for an H-1B if I'm currently on OPT?
Yes, and cap-exempt districts can file your H-1B petition while you're on OPT without tying the start date to October 1. If your OPT expires before the petition is approved, you'll need to ensure your employer files before your authorization lapses or that you have a STEM OPT extension in place. Confirm the district's HR team understands the cap-exempt timeline so they don't delay the filing unnecessarily.
