Verify your degree meets specialty occupation standards
USCIS requires a direct nexus between your degree field and the Staff Engineer role. A computer science or engineering degree is straightforward, but an unrelated bachelor's may draw an RFE. Pull your O*NET profile for the occupation to document the degree requirement before your employer files.
Target employers with cap-exempt filing pathways
Universities, nonprofit research institutions, and affiliated entities are cap-exempt, meaning they can file H-1B petitions year-round without waiting for the April lottery. Staff Engineer roles exist at these organizations, and a cap-exempt filing eliminates lottery risk entirely.
Search verified H-1B sponsors on Migrate Mate
Filter Staff Engineer roles on Migrate Mate to surface employers with confirmed H-1B LCA filing history for this job title. You'll see which companies have filed for the role before, so you're not guessing about sponsorship willingness during the interview process.
Negotiate offer timing around the H-1B cap deadline
H-1B cap petitions must be filed by April 1 for an October 1 start. If you're receiving an offer in Q1, ask HR explicitly whether they'll file by the deadline. An offer signed in March with no filing commitment leaves you in gap-year territory.
Request premium processing to compress adjudication timelines
USCIS premium processing guarantees a decision within 15 business days. For Staff Engineer roles with competing offers or a hard start date, ask your employer to elect premium processing on the I-129. It shifts adjudication risk from months to weeks.
Use the OFLC Wage Search to confirm your prevailing wage level
DOL assigns Staff Engineer petitions to wage levels I through IV based on experience and supervision. Run the OFLC Wage Search before salary negotiations so you know which level your role maps to. A Level III or IV designation raises the floor your employer must meet on the LCA.
H-1B Visa Staff Engineer: Frequently Asked Questions
Does a Staff Engineer role qualify as an H-1B specialty occupation?
Yes. Staff Engineer positions typically require at least a bachelor's degree in computer science, software engineering, electrical engineering, or a closely related field, which satisfies the USCIS specialty occupation definition. Employers document this on the LCA by citing the degree requirement in the job description. If your employer's posting says a degree is 'preferred' rather than 'required,' USCIS may issue an RFE, so the language in the job description matters.
How do I find Staff Engineer employers who actively sponsor H-1B visas?
Migrate Mate filters Staff Engineer roles by employers with documented H-1B LCA filing history, so you can focus your applications on companies that have sponsored the role before rather than cold-asking recruiters about immigration policy. This saves significant time during the job search and reduces the risk of pursuing roles at employers who don't sponsor.
Can I stay in H-1B status if my Staff Engineer role is eliminated during a layoff?
You have a 60-day grace period after your H-1B employment ends to find a new sponsor, change to another visa status, or depart the U.S. During that window you can't work, but you can interview and negotiate offers. If a new employer files an H-1B transfer before the grace period expires, you can begin work once USCIS receives the petition.
What wage level does a Staff Engineer job map to under DOL prevailing wage rules?
DOL assigns H-1B positions to wage levels I through IV. Staff Engineer roles with independent project ownership and mentorship responsibilities typically map to Level III or IV, which carry higher prevailing wage floors. You can verify the applicable wage level for your specific location and job duties using the OFLC Wage Search before entering salary negotiations with a prospective sponsor.
Is a Staff Engineer role eligible for an H-1B cap exemption?
Cap exemptions apply to the employer, not the role. If you're hired by a university, nonprofit research organization, or an entity affiliated with one, the H-1B petition can be filed at any time without entering the lottery. Most private tech companies are cap-subject, so petitions must be filed in April for an October 1 start. Confirming your employer's cap status early in the offer process prevents scheduling conflicts.
