Verify your degree field matches the role
USCIS requires a direct relationship between your degree and the specialty occupation. A degree in systems engineering, aerospace, or industrial engineering maps cleanly. Computer science or physics degrees may require a credential evaluation to establish the nexus.
Target defense and aerospace prime contractors
System safety roles concentrate at defense primes, NASA contractors, rail transit authorities, and aviation OEMs. These employers file H-1B petitions routinely and have dedicated immigration counsel, which reduces your risk of a poorly prepared petition.
Search LCA filings by occupation code on Migrate Mate
Pull DOL Labor Condition Application data filtered to SOC code 17-2112 to see which employers have actively sponsored System Safety Engineers. This shows real filing history, not just job postings, so you target sponsors with a track record.
Confirm your role qualifies as specialty occupation
System safety engineering spans software, hardware, and procedural domains. If your duties include non-engineering tasks like program management, USCIS may challenge specialty occupation status. Get a written job description from your employer that anchors your role in MIL-STD-882 or equivalent safety standards.
Negotiate filing before the cap registration window
H-1B cap registration opens in March each year. If you're already in the U.S. on OPT or another status, give your employer enough lead time to prepare the I-129 petition. Premium processing adds 15 business days and protects against cap-gap uncertainty if your OPT expires before October 1.
Check prevailing wage tier before accepting an offer
Use the OFLC Wage Search to look up the Level I through Level IV wage for your job title and work location before signing. The LCA must certify at or above your offered wage, and mismatches between offer letters and LCA wages are a common filing error.
H-1B Visa System Safety Engineer: Frequently Asked Questions
Does System Safety Engineer qualify as an H-1B specialty occupation?
Yes. System Safety Engineer meets the H-1B specialty occupation standard because the role typically requires at least a bachelor's degree in systems engineering, aerospace engineering, or a closely related field. USCIS assesses whether a theoretical and practical application of highly specialized knowledge is required. If your job description ties directly to recognized safety standards such as MIL-STD-882, that strengthens the specialty occupation argument significantly.
Which employers sponsor H-1B visas for System Safety Engineers?
Defense contractors, aerospace manufacturers, rail transit agencies, and aviation OEMs are the most consistent H-1B sponsors for this role. Because many positions involve defense contracts, employers already maintain immigration infrastructure to support foreign national hires. You can identify sponsors with actual filing history for this occupation by browsing System Safety Engineer jobs on Migrate Mate, which surfaces DOL Labor Condition Application data by employer.
How does a security clearance affect H-1B sponsorship for this role?
A security clearance requirement doesn't disqualify you from H-1B sponsorship, but it does create a sequencing problem. The employer files the H-1B petition first, then pursues clearance sponsorship separately. Some defense positions are designated as requiring U.S. citizenship, which would exclude H-1B workers entirely. Clarify whether the specific role requires a clearance and, if so, which level, before your employer begins the H-1B filing process.
Can I transfer my H-1B to a new employer in a System Safety Engineer role?
Yes. Under H-1B portability, you can start working for a new employer as soon as they file a new I-129 petition, provided you've maintained valid H-1B status and the new role also qualifies as a specialty occupation. Because system safety engineering duties vary by industry, confirm that the new job description still maps to the specialty occupation definition before your employer files.
What documents should I gather before my employer files the H-1B petition?
You'll need official transcripts, your degree certificate, and a credential evaluation if your degree was issued outside the U.S. Because USCIS evaluates the nexus between your degree field and the specific role, gather any professional certifications, such as a Certified System Safety Professional designation, that reinforce the specialty occupation argument. Your employer's attorney will also need your passport, current immigration documents, and a detailed job description tied to recognized safety engineering frameworks.
