Align your degree to the role
Automation Engineer is a specialty occupation requiring a directly related bachelor's degree. A degree in mechanical, electrical, or systems engineering typically qualifies. A computer science degree may qualify if your role centers on control systems or industrial software.
Verify the prevailing wage before negotiating
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your specific SOC code and work location. Check the OFLC Wage Search before your salary discussion so you know the floor your offer must meet.
Target manufacturers with existing LCA filing history
Use Migrate Mate to filter employers by verified H-1B1 Chile LCA filings for automation and controls roles. Companies that have filed before already understand the process, which shortens the time between offer and consulate appointment.
Clarify your role's classification with O*NET
Automation Engineer titles vary widely across industries. Pull your job description against the O*NET occupation profile for Industrial Engineers or Electrical Engineers before your interview so you can confirm specialty occupation status if a consular officer asks.
Get your LCA certified before scheduling the interview
DOL typically certifies LCAs within seven business days. Don't book your consulate appointment until the certified LCA is in hand. Arriving without it forces a reschedule, which can add weeks depending on appointment availability at your consulate.
Prepare a concurrent status plan if switching employers
H-1B1 Chile status isn't portable the way H-1B visa is. If you change employers, your new employer must file a fresh LCA and you'll need a new visa stamp. Factor that gap into your transition timeline and keep your Chilean passport current.
Frequently Asked Questions
Does an Automation Engineer role qualify as a specialty occupation for the H-1B1 Chile visa?
Yes, if the position requires at least a bachelor's degree in a directly related field such as electrical engineering, mechanical engineering, or systems engineering. Roles focused on PLC programming, SCADA systems, or industrial controls generally meet the specialty occupation standard. Generalist technician roles that don't require a specific degree field can fall short, so your offer letter should clearly state the degree requirement.
How does the H-1B1 Chile visa differ from the H-1B for Automation Engineers?
The H-1B1 Chile visa skips the H-1B lottery entirely and is processed at the U.S. consulate in Chile rather than through USCIS. The annual cap is 1,400 visas and has never been exhausted. The trade-off is that H-1B1 doesn't allow dual intent, so maintaining clear nonimmigrant intent matters, and status isn't portable between employers the way H-1B portability works under AC21.
How can I find employers who sponsor H-1B1 Chile visas for Automation Engineer positions?
Migrate Mate lets you search specifically for employers with verified H-1B1 Chile LCA filing history in engineering and automation roles. This filters out companies that have never navigated the process and surfaces ones already familiar with the LCA requirements, consulate timelines, and prevailing wage obligations specific to your target location and SOC code.
What documents should I bring to my H-1B1 Chile consulate interview as an Automation Engineer?
You'll need your certified LCA, the job offer letter specifying your role and degree requirement, your degree certificate and transcripts, your DS-160 confirmation, the MRV fee receipt, and a valid Chilean passport. If your degree is not from a Chilean or U.S. institution, bring a credential evaluation from a NACES-member evaluator confirming U.S. equivalency.
Does my employer need to file anything with USCIS to sponsor my H-1B1 Chile visa?
No USCIS petition is required. Your employer files the Labor Condition Application with DOL through the FLAG system, and DOL certifies it. You then apply for the visa directly at the U.S. consulate in Chile using that certified LCA alongside your DS-160 and supporting documents. USCIS is not involved in H-1B1 Chile processing.
