Align your credentials to specialty occupation standards
USCIS requires that your commissioning role demands a bachelor's degree or higher in a specific technical field. Map your Chilean engineering degree and project-specific experience to the exact job duties before your employer files anything.
Target employers with active LCA filing history
Search Migrate Mate to identify companies that have filed Labor Condition Applications for commissioning or industrial engineering roles, not just generic engineering titles. Prior H-1B1 visa filings signal an employer already understands the process.
Request an LCA that reflects your actual work location
Commissioning Managers often move between project sites. Your employer's LCA must list every worksite or use a blanket LCA covering multiple locations, or DOL can flag noncompliance during a wage audit.
Use the OFLC Wage Search before negotiating your offer
Your offer must meet the prevailing wage for your SOC code and work location. Pull the DOL wage level yourself using the OFLC Wage Search before accepting any offer so you know whether the role qualifies and at what wage floor.
Prepare your credential equivalency documentation early
Chilean engineering degrees vary in structure from U.S. four-year programs. Get a credential evaluation from a NACES-approved evaluator before you start interviewing so employers see a ready-to-file package, not a potential delay.
Clarify the consulate process with your prospective employer
Unlike H-1B visa, H-1B1 Chile is approved at the U.S. consulate in Santiago rather than through USCIS. Many U.S. hiring managers don't know this distinction, so walk them through the timeline so the offer letter and I-129 are structured correctly.
Frequently Asked Questions
Does a Commissioning Manager role qualify as a specialty occupation for the H-1B1 Chile visa?
Yes, if the position requires a bachelor's degree or higher in engineering, industrial technology, or a directly related field. Commissioning Manager roles in energy, oil and gas, manufacturing, and construction typically meet this bar because they require applying specialized technical knowledge. If the job description only requires a general degree in any field, it won't qualify, so the job posting language matters.
How does the H-1B1 Chile visa compare to the H-1B for Commissioning Manager positions?
For Chilean nationals, the H-1B1 Chile visa is almost always faster and more predictable. There is no lottery, the 1,400-visa annual cap rarely fills, and approval happens at the Santiago consulate rather than through USCIS petitions. The tradeoff is that H-1B1 does not allow dual intent, meaning you can't use it to pursue a green card while on status the way some H-1B holders do.
How can I find Commissioning Manager jobs where employers already understand H-1B1 Chile sponsorship?
Migrate Mate filters job listings by verified LCA filing history, so you can identify employers that have already navigated the H-1B1 or H-1B process for technical roles. This saves time during outreach because you're targeting companies familiar with the paperwork rather than educating employers from scratch.
Can I switch employers if my Commissioning Manager project ends before my H-1B1 Chile status expires?
Yes, but your new employer must file a new I-129 and obtain a new certified LCA before you start working for them. Because H-1B1 Chile is employer-specific, there is no portability provision like the one that exists for certain H-1B holders under AC21. Plan for a gap between project completion and your new start date, and make sure your status doesn't lapse.
What happens if my Commissioning Manager role requires travel to multiple U.S. job sites?
Your employer's LCA must cover every location where you work for more than a short-term period. DOL defines short-term as up to 10 consecutive workdays or 30 total workdays in a year at a non-listed location. For project-based commissioning work that rotates across sites, your employer should either list all primary sites on the LCA or file an amended LCA if the work location changes significantly.
