Verify your degree qualifies as specialty occupation
Instructor roles must require at least a bachelor's degree in a directly related field to qualify under H-1B1 visa. Pull your O*NET occupation profile for the specific teaching discipline to confirm the degree requirement before approaching employers.
Target institutions with active LCA filing history
Universities, community colleges, and corporate training centers that have filed Labor Condition Applications for instructors in the past are already familiar with H-1B1 Chile sponsorship mechanics. Use Migrate Mate to filter employers by LCA filing history for your exact role.
Get your credentials evaluated before applying
Chilean academic credentials, including three-year licenciatura degrees, must be evaluated by a NACES-member organization to demonstrate U.S. bachelor's equivalency. Submit your evaluation report alongside your CV so employers can confirm specialty occupation eligibility without delay.
Confirm your employer files the LCA before your consulate date
Under H-1B1 visa, the employer submits the LCA to DOL for certification, but you file your visa application directly at the consulate. The certified LCA must be in hand before your interview, so confirm your employer's DOL submission timeline at the offer stage.
Use OFLC Wage Search to benchmark your offer
Your employer's LCA must certify wages at or above the prevailing wage for your specific instructor role and metro area. Run the OFLC Wage Search by Standard Occupational Classification code and location before accepting an offer to confirm the salary meets DOL requirements.
Prepare your nonimmigrant intent documentation early
Unlike H-1B visa, the H-1B1 visa does not allow dual intent, so consular officers will assess your ties to Chile. Gather documents showing property ownership, family connections, or professional registrations in Chile to support your nonimmigrant intent before your interview.
Frequently Asked Questions
Does an Instructor role qualify as a specialty occupation for H-1B1 Chile?
Yes, provided the position requires at least a bachelor's degree in a field directly related to the instruction subject. A general education or unrelated degree typically won't satisfy the requirement. Your employer's LCA must identify the specific occupational category, and your credentials should clearly align with the subject matter you'll teach.
How does the H-1B1 Chile visa compare to H-1B for Instructor positions?
H-1B1 Chile has a dedicated annual cap of 1,400 visas that has never been exhausted, so there's no lottery and no USCIS petition required. You apply directly at the consulate with a DOL-certified LCA. The tradeoff is that H-1B1 doesn't allow dual intent, so you can't use it as a step toward a green card the way H-1B holders sometimes do.
How do I find Instructor employers who already sponsor H-1B1 Chile visas?
Migrate Mate lets you search for Instructor roles filtered by employers who have filed Labor Condition Applications for this occupation, giving you a concrete shortlist of institutions already familiar with H-1B1 Chile sponsorship. This cuts out the time spent educating HR teams from scratch about a visa category many haven't encountered.
Can my Chilean three-year university degree satisfy the specialty occupation requirement?
A Chilean licenciatura or equivalent three-year degree can qualify if a NACES-accredited credential evaluation confirms U.S. bachelor's equivalency. The evaluation report should state the equivalent degree level and field. Consular officers and DOL both expect this documentation when the degree structure differs from the standard U.S. four-year model.
What happens to my H-1B1 status if my Instructor contract ends between academic terms?
H-1B1 Chile doesn't carry the same grace period provisions as H-1B, so a gap between contracts can create status complications. If your teaching contract is term-based rather than annual, confirm with your employer whether the appointment letter covers the full academic year or needs to be renewed each semester before your visa interview.
