INTRODUCTION
The Farmworker will perform a combination of the following duties in connection with growing a variety of certified organic vegetables including, middle eastern crops, cabbage, broccoli, carrots, greens, cucumbers, eggplant, herbs, onions, peppers, tomatoes, squash among others.
ROLE AND RESPONSIBILITIES
- Participate in all aspects of crop production including soil preparation, greenhouse seeding, transplanting, cultivation, weeding, pruning, watering, harvesting, washing and marketing.
- Harvest full-grown crops requiring digging, picking, loading lifting.
- Load and transport harvested crops to market.
- Work in all weather conditions.
- Additional hours required as necessary based on weather and crop progression.
- Hours may vary based on weather and crop conditions.
BASIC QUALIFICATIONS
- 1 month of experience as farmworker.
EMERGENCY JUSTIFICATION
We respectfully request a waiver of the standard H-2A filing timeline under 20 CFR § 655.134 due to an emergency situation that constitutes good and substantial cause. Our operation has fully utilized all available planting space and, until recently, had no additional land on which to plant. We have now secured additional acreage, but must begin planting immediately to make use of this land. As we are currently midway through the planting season, strict adherence to the planting schedule is critical to maintaining production. Certain crops must be planted between May 30 and June 10. Missing this narrow planting window will prevent these crops from being produced this season and will result in losses of hundreds of thousands of dollars, creating an extreme financial hardship and jeopardizing ongoing operations. Without this emergency waiver, we will be unable to plant more than half of our winter crops, including squash, dry beans, and beets. These crops require approximately 110 days to cultivate and harvest, making timely planting essential. In addition, our storage crops must be planted within the first two weeks of June and harvested by the end of September. Failure to meet this schedule will result in further substantial financial losses. Our farm serves more than 100,000 customers and New Yorkers annually. An inability to plant and produce these crops would lead to significant financial losses due to unharvested produce, the loss of long-standing customer relationships and irreparable damage to our business reputation and future market access.
