Position Overview
We are looking for a upper-mid to senior level Attorney with at least 10 years of experience possessing transactional, corporate and/or litigation experience to join our Legal Department in one of our legal hub offices located in Omaha or Kansas City. In this role, you will have the opportunity to participate in various legal functions within the department, including: providing advice and assistance to the company and its various home office functional groups, managing major commercial litigation and disputes, reviewing and negotiating large, complex construction contracts with owners, partners, and critical vendors/subcontractors, and supporting business units and profit centers by acting as dedicated legal support as well as engaging with key members of senior management. Contract models could include EPC, design-build, progressive design-build, integrated project delivery/alliance modeling, joint venture agreements, memoranda of understanding, teaming agreements, consortium agreements, and material contracts. Matters involve significant monetary amounts and involve some of the largest high-profile construction projects being constructed in North America today.
Critical thinking, problem-solving and excellent judgment are key qualities to achieve success in this role. The position will report to the Group General Counsel.

Location
This position will be based in one of the following locations: our downtown Omaha, NE Headquarters or our regional Lenexa, KS campus. This is not a remote work option.
Responsibilities
- Provide regular and ongoing legal advice with respect to legal issues facing the Company.
- Assist and coordinate with other members of the Legal Department with other legal needs of the Company, as necessary.
- Provide comprehensive oversight of all legal matters of each District and provide a full range of timely and responsive legal advice and support to each District Management.
- Draft joint venture agreements, consortiums, MOU’s, term sheets, and other service agreements and associated transactional documents.
- Ensure the Company’s contracting protocols, commercial standards and guidelines are followed.
- Collaborate with the internal stakeholders and subject matter experts relative to the legal aspects and risks of matters assigned.
- Review, negotiate, draft, and analyze various types of Company contracts.
- Draft joint venture agreements, consortiums, MOU’s, term sheets, and other service agreements and associated transactional documents.
- Develop and deliver training to the larger organization on a variety of legal issues.
- Coordinate negotiations on major subcontracts with the business lead and internal supply network lead.
- Perform initial case assessment and perform detailed review of relevant contractual provisions, facts, and applicable law to provide early accurate case/matter risk assessment.
- Participate as an integral member of teams in the evaluation and development of detailed claims utilizing Kiewit’s proprietary method. Retain and collaborate with outside counsel, internal resources, and external experts on the resolution of claims, disputes, and other matters.
- Coordinate resolution strategy with the internal stakeholders and subject matter experts.
- Lead strategic management of assigned legal matters in collaboration with internal and external resources and stakeholders.
Qualifications
- Minimum of 10 years of transactional, corporate and/or litigation experience with a large law firm and/or in-house legal department with experience similar as detailed above.
- J.D. and active attorney’s license.
- Effective organizational skills and ability to prioritize and manage multiple time-sensitive projects simultaneously.
- Pragmatic judgment, particularly in determining the significance of legal matters and effectively measuring and balancing legal and business risks.
- Excellent written and oral communications skills, with ability to synthesize complex legal issues to essential elements for internal clients and interact with Sr. leaders and C-Suite.
- Self-driven & resourceful to achieve goals independently as well as in groups in a demanding environment. Must have excellent negotiation skills, presentation, and meeting facilitation skills.
- Background in construction law, government contracts, government investigations, environmental law and labor law preferred but not necessary.
