How to Get Visa Sponsorship in Chief Operating Officer
Establish clear organizational authority
COO visa petitions succeed when the job description reflects direct control over entire departments or functions. Vague titles like 'senior operations leader' without documented reporting structures weaken H-1B specialty occupation and EB-1C executive classification arguments significantly.
Target companies with prior sponsorship history
Established multinationals and late-stage startups have immigration counsel in place and understood processes. First-time sponsors at the COO level face longer timelines and higher legal costs, so prioritizing experienced sponsors materially improves your odds of a smooth process.
Build your O-1A case alongside the job search
COOs with board memberships, published industry commentary, keynote speaking credits, or major contract awards may qualify for O-1A extraordinary ability. This visa bypasses the H-1B lottery entirely, making it worth documenting achievements systematically before your first interview.
Understand the EB-1C multinational manager path
If you've held a managerial or executive role abroad with the same company for at least one year in the past three, EB-1C offers a direct green card route. Many COO candidates miss this because they don't realize prior overseas employment qualifies.
Negotiate legal fee coverage upfront
Immigration attorneys for executive-level sponsorship commonly charge more than standard H-1B filings due to complexity. Raising this during offer negotiation is standard at the COO level. Employers who hesitate signal they haven't done this before or aren't fully committed to sponsoring you.
Document your specialty occupation argument clearly
H-1B approval for COO roles requires demonstrating the position requires at minimum a bachelor's degree in a specific specialty. Operations strategy, business administration, or supply chain management degrees typically satisfy this, but generic management experience alone usually does not.

Can a Chief Operating Officer role qualify for H-1B sponsorship?
Yes, but it requires careful documentation. USCIS must be convinced the COO role is a specialty occupation requiring at least a bachelor's degree in a specific field such as business administration, operations management, or engineering. Broadly written job descriptions that emphasize general leadership without field-specific degree requirements are the most common reason COO H-1B petitions face RFEs or denials.
Is the EB-1C green card a realistic path for COOs?
For COOs joining a U.S. subsidiary, affiliate, or branch of a company where they previously held a managerial or executive role abroad for at least one year within the past three years, EB-1C is one of the most direct green card routes available. It skips PERM labor certification entirely, which makes it significantly faster than EB-2 or EB-3 pathways for qualifying candidates.
What visa options exist for COO candidates who don't win the H-1B lottery?
O-1A extraordinary ability is the strongest alternative for COOs with a documented track record of industry recognition, board roles, major deal leadership, or high compensation relative to peers. E-3 applies if you hold Australian citizenship. TN applies for Canadian and Mexican nationals whose background fits qualifying categories. Each of these bypasses the H-1B lottery entirely.
How do I find COO roles where employers are genuinely open to visa sponsorship?
Migrate Mate filters job listings specifically by visa sponsorship eligibility, which removes the guesswork of approaching companies that won't sponsor executive hires. COO sponsorship is less common than mid-level roles, so filtering by sponsorship willingness upfront saves significant time. You can browse current COO openings directly on Migrate Mate.
Does a three-year Australian bachelor's degree satisfy the H-1B degree requirement for a COO role?
Generally yes. USCIS and most immigration attorneys treat Australian three-year bachelor's degrees as equivalent to U.S. four-year degrees for H-1B purposes, provided the field is relevant to the COO position. A credential evaluation from a recognized agency such as NACES member organizations is typically included in the petition to formally document equivalency.
What is the prevailing wage requirement for sponsored Chief Operating Officer jobs?
U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
