How to Get Visa Sponsorship in Deputy Attorney General
Target private sector legal departments
Corporate legal departments and large law firms are more likely to sponsor visas than government agencies, which often require U.S. citizenship for deputy-level positions.
Emphasize specialized legal expertise
Highlight niche areas like securities law, international compliance, or regulatory affairs that demonstrate the specialized knowledge requirement for H-1B and O-1 visas.
Document leadership experience thoroughly
O-1A petitions for legal executives require evidence of leading roles. Compile documentation of team management, major case leadership, and organizational impact achievements.
Consider EB-2 National Interest Waiver
Senior legal roles involving regulatory compliance or public policy may qualify for NIW green cards, bypassing the PERM labor certification requirement entirely.
Research state bar admission requirements
Many states allow foreign attorneys to take the bar exam with specific educational credentials. Plan your bar admission strategy alongside visa sponsorship applications.
Prepare for prevailing wage challenges
Attorney positions often have wide salary ranges. Work with employers to accurately classify the role level to ensure PERM and LCA wage requirements are met.

Get Access To All JobsFrequently Asked Questions
Do Deputy Attorney General positions qualify for H-1B visas?
Yes, if the role requires a J.D. and involves specialized legal knowledge. However, many government deputy attorney general positions require U.S. citizenship, limiting opportunities to private sector equivalents in corporate legal departments or law firms.
What degree is required for visa sponsorship in legal executive roles?
A J.D. from an accredited law school is typically required, though some positions may accept equivalent foreign law degrees plus relevant experience. LL.M. degrees from U.S. schools can strengthen H-1B and O-1 petitions for foreign attorneys.
Are O-1A visas realistic for Deputy Attorney General roles?
Yes, particularly for attorneys with significant leadership experience, published legal scholarship, or recognition in specialized practice areas. O-1A requires demonstrating extraordinary ability through sustained national recognition, making it suitable for senior legal executives.
How does bar admission affect visa sponsorship for attorneys?
Bar admission isn't required for H-1B filing, but many employers prefer licensed attorneys. Some states allow foreign attorneys to sit for the bar exam with qualifying education. Plan bar admission alongside visa sponsorship to maximize opportunities.
Can Deputy Attorney General experience lead to EB-2 National Interest Waiver?
Potentially, especially if the role involves regulatory policy, public interest law, or national security matters. NIW requires demonstrating that your work benefits the U.S. national interest and that waiving labor certification requirements serves the national interest.
What is the prevailing wage requirement for sponsored Deputy Attorney General jobs?
U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
