How to Get Visa Sponsorship as a Family Law Paralegal
Target firms with active immigration caseloads
Family law firms that handle immigration matters alongside divorce and custody cases are more familiar with visa sponsorship. Their existing relationships with immigration counsel make the H-1B or E-3 petition process significantly less intimidating for hiring managers.
Emphasize your specialized legal knowledge
Highlight expertise in family court procedures, discovery, and case management software. Employers are more likely to sponsor candidates whose skills justify the time and cost of petitioning, so make your specialized knowledge impossible to overlook in applications.
Pursue ABA-approved paralegal certification
Certifications from the National Association of Legal Assistants or similar bodies strengthen your specialty occupation case for H-1B purposes. They signal formal credentials beyond a degree alone, which matters when USCIS evaluates whether your role qualifies.
Focus on mid-size and large law firms
Boutique solo practices rarely have the resources or HR infrastructure to sponsor visas. Mid-size firms with dedicated HR departments and large firms with in-house counsel are far better positioned to handle the sponsorship process without viewing it as a burden.
Be upfront about your visa status early
Disclose your need for sponsorship before the final interview stage. Law firms move deliberately and need time to consult immigration counsel. Surprises late in hiring create delays and sometimes withdrawal of offers, even when the firm is otherwise willing.
Browse sponsorship-open roles on Migrate Mate
Migrate Mate filters job listings specifically for visa-sponsoring employers, saving you from applying blindly. Family law paralegal roles with confirmed sponsorship willingness are surfaced directly, so you spend time on opportunities that are actually viable for your situation.

Get Access To All JobsFrequently Asked Questions
Can family law paralegals get H-1B visa sponsorship?
Yes, but the role must qualify as a specialty occupation, meaning it requires a bachelor's degree or higher in a specific field. Family law paralegal positions that demand a degree in paralegal studies, legal studies, or a related discipline generally meet the standard. Roles where any degree suffices regardless of field face more scrutiny from USCIS during adjudication.
Does a three-year Australian bachelor's degree qualify for an E-3 visa as a family law paralegal?
Generally yes. USCIS and U.S. consular officers typically accept Australian three-year bachelor's degrees as equivalent to a U.S. four-year degree for E-3 purposes. Your degree should be in a field directly related to the paralegal role, such as legal studies, law, or a social science discipline. A credential evaluation letter can strengthen your application if the relevance isn't immediately obvious.
What makes a family law paralegal role harder to sponsor than other legal positions?
The specialty occupation requirement is the main hurdle. If a firm historically hires paralegals without requiring a specific degree, USCIS may argue the position doesn't qualify. Firms that have documented degree requirements in their job descriptions and can show internal policies requiring specific credentials are in a much stronger position when petitioning. Paralegal certification helps reinforce the specialty occupation argument.
Are there visa options for family law paralegals who don't win the H-1B lottery?
Yes. Australian citizens can pursue the E-3 visa, which has no lottery and a far lower utilization rate. TN status is available to Canadian and Mexican nationals in qualifying legal roles. O-1A is an option for paralegals with demonstrated extraordinary achievements in the legal field. You can find family law paralegal roles open to these visa types directly through Migrate Mate, which filters for sponsorship-willing employers.
What documents should I expect my employer to prepare for H-1B sponsorship as a paralegal?
Your employer needs to file a Labor Condition Application with the Department of Labor certifying prevailing wage compliance, then submit Form I-129 with supporting evidence that the role qualifies as a specialty occupation. You'll need to provide degree transcripts, a credential evaluation if your degree is foreign, and documentation of any relevant certifications. The firm's immigration counsel typically prepares the specialty occupation argument, which is the most scrutinized component for paralegal petitions.
What is the prevailing wage requirement for sponsored Family Law Paralegal jobs?
U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
