Target employers with consistent H-1B filing histories
Companies that have sponsored fullstack engineers in the past are far more likely to do it again. Look for employers with multiple approved LCA filings for software roles, not just a single prior petition. Past behavior is the strongest predictor of willingness.
Make your stack explicit on your resume
USCIS evaluates specialty occupation based on the specific technical requirements of the role. Listing React, Node.js, PostgreSQL, and cloud infrastructure signals a degree-level position more clearly than a generic 'software engineer' title alone.
Understand the LCA before your offer stage
Your employer files a Labor Condition Application with the Department of Labor before your H-1B petition. It certifies the offered wage meets prevailing levels for your location and role. Ask HR where you fall in the wage tier during negotiations.
A computer science degree is not the only qualifying credential
USCIS accepts degrees in software engineering, information systems, mathematics, and related fields. Three years of specialized work experience can substitute for one year of education, so a two-year degree plus six years of experience may still qualify you.
Cap-exempt employers can sponsor you outside the H-1B lottery
Universities, nonprofit research organizations, and certain government entities are exempt from the annual H-1B cap. Fullstack engineers at these institutions can be sponsored year-round without waiting for the April lottery window to open.
Start the sponsorship conversation early in the hiring process
Many engineering teams are willing to sponsor but defer to HR, who may be unfamiliar with the process. Raising it during the offer stage, not after signing, gives the company time to engage immigration counsel and avoids delays before your start date.
Frequently Asked Questions
Does a Senior Fullstack Software Engineer role qualify as a specialty occupation for H-1B purposes?
Yes, in almost all cases. USCIS considers software engineering a specialty occupation because the role normally requires at least a bachelor's degree in computer science, software engineering, or a directly related field. The more your job description specifies technical systems, architecture decisions, or complex problem-solving, the stronger the specialty occupation argument. Generic job postings that say 'any degree accepted' can weaken the petition, so job title and description wording matters.
What visa types are most commonly used to sponsor fullstack software engineers?
H-1B visa is the most common path for fullstack engineers without prior U.S. status. L-1B is used for intracompany transfers with specialized knowledge. O-1A applies to engineers with demonstrated extraordinary ability, such as open-source contributions, conference talks, or patents. Australian citizens can use the E-3 visa, which has no lottery. Canadian and Mexican nationals may qualify under the TN visa for software engineers. Browse Migrate Mate to find roles filtered by visa type.
How does the H-1B lottery affect my chances as a senior fullstack engineer?
The lottery itself is random and doesn't favor your experience level or title. In fiscal year 2025, USCIS received roughly 442,000 registrations for 85,000 slots, a selection rate near 25%. However, seniors with master's degrees from U.S. institutions enter a separate, smaller pool first, which historically offers better odds. Employers with cap-exempt status bypass the lottery entirely, making them strategically valuable targets.
Can I transfer my H-1B to a new employer if I change jobs as a fullstack engineer?
Yes. H-1B portability allows you to start working for a new employer as soon as they file a transfer petition, as long as your previous H-1B was approved and you've maintained valid status. You don't need to wait for the new petition to be approved. The new employer must still file a fresh LCA and I-129, and the role must continue to qualify as a specialty occupation.
Do employers actually sponsor senior fullstack engineers, or is it mostly junior roles?
Senior roles are actually sponsored at higher rates than junior ones. At the senior level, employers have already invested in assessing your skills, the business case for sponsorship is clearer, and companies are less willing to lose a strong candidate over visa paperwork. Large tech companies, growth-stage startups, and consulting firms all regularly sponsor at the senior level. Migrate Mate lists sponsorship-open fullstack roles specifically, so you're not guessing which employers are willing.
What is the prevailing wage requirement for sponsored Senior Fullstack Software Engineer jobs?
U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
