Get Access To All JobsTips for Finding Visa Sponsorship as a Software Development Manager
Lead with your technical depth, not just your management credentials
USCIS scrutinizes whether Software Development Manager roles qualify as specialty occupations. Emphasizing your hands-on engineering background alongside leadership experience strengthens the case that the role requires specialized technical knowledge.
Target companies with a proven H-1B sponsorship track record
Large tech employers and established software firms file H-1B petitions for this role regularly. A company's history of approved petitions for similar positions signals that their legal team understands the process and will support your application.
Ensure your degree aligns with the role's technical requirements
A degree in computer science, software engineering, or information systems provides the clearest path to specialty occupation approval. Degrees in adjacent fields can qualify, but expect closer scrutiny and stronger supporting documentation from your employer.
Understand the L-1A pathway if you're transferring within a multinational
If you currently work for a company with U.S. operations, the L-1A intracompany transferee visa may be faster than the H-1B lottery. It applies to managers and executives and bypasses the annual cap entirely.
Prepare for Requests for Evidence on the managerial classification
USCIS sometimes issues RFEs questioning whether Software Development Manager roles involve true managerial duties versus technical work. Detailed job descriptions, org charts, and documentation of direct reports significantly reduce this risk.
Time your job search around the H-1B registration window
H-1B registration opens in March each year for an October 1 start date. Starting your job search by January gives you time to secure an offer, complete the LCA filing, and meet your employer's internal deadlines before registration closes.
Frequently Asked Questions
Does a Software Development Manager role qualify as an H-1B specialty occupation?
Yes, but the petition needs to clearly establish that the role requires at minimum a bachelor's degree in a specific technical field. Job descriptions that emphasize strategic leadership without referencing technical degree requirements invite RFEs. The strongest petitions document both the managerial scope and the specialized engineering knowledge the position demands.
What visa options exist for Software Development Managers beyond the H-1B?
The L-1A is a strong alternative for managers transferring from a foreign affiliate or parent company to a U.S. office. It has no annual cap and no lottery. O-1A is available for candidates with documented extraordinary ability. Australian citizens can also explore the E-3 visa, which has its own separate annual allocation.
How can I find Software Development Manager jobs that offer visa sponsorship?
Migrate Mate lists Software Development Manager roles specifically filtered for visa sponsorship availability. Filtering by sponsorship willingness saves significant time compared to applying broadly and discovering late in the process that a company does not support H-1B visa petitions.
Does my degree field matter if I have extensive engineering management experience?
It matters significantly for H-1B purposes. USCIS evaluates whether the specific degree requirement is tied to the role, not just whether you're qualified. If your degree is in a non-technical field, your employer's attorney may need to document equivalent education through a combination of coursework and progressive work experience, following the three-for-one rule.
What H-1B approval rates look like for Software Development Manager petitions?
Approval rates for managerial roles in software are generally strong at established tech employers with documented sponsorship histories. Denials and RFEs are more common at smaller companies filing for the first time or where the job description conflates management with individual contributor work. Clarity in the petition about supervisory duties and headcount is the most effective safeguard.
What is the prevailing wage requirement for sponsored Software Development Manager jobs?
U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
