Get Access To All JobsTrial Attorney CPT: Frequently Asked Questions
Does Trial Attorney work qualify as CPT for an F-1 student?
Yes, if your law school's curriculum includes a clinical program, externship course, or practicum that requires supervised litigation experience. The placement must be an integral part of a specific course you're enrolled in, and your DSO must authorize it on your I-20 before you start work. Purely voluntary or extracurricular legal work does not count.
Can I do CPT at a private law firm instead of a government office?
Yes. Private law firms, public interest organizations, corporate legal departments, and government prosecutor or defender offices all qualify as CPT employers as long as the work aligns with your academic program and your school approves the placement. The key requirement is curriculum integration, not employer type. Confirm that the firm is willing to sign any documentation your school requires.
How do I find law firms and legal employers that are open to CPT students?
Use Migrate Mate to identify legal employers with a history of sponsoring attorneys and engaging with F-1 work authorization processes. Firms that have previously navigated visa paperwork are typically more familiar with CPT authorization requirements and less likely to rescind offers over documentation timelines.
What happens if my CPT authorization expires mid-semester before my placement ends?
You must stop working immediately if your CPT authorization lapses. CPT is authorized on a semester-by-semester basis, and working even one day beyond the end date on your I-20 is an unauthorized employment violation. Contact your DSO at least two to three weeks before the expiration date to renew, and confirm the new I-20 is in hand before continuing.
Does full-time CPT affect my future OPT eligibility?
Yes. Under USCIS rules, 12 months or more of full-time CPT used before graduation eliminates your post-completion OPT eligibility entirely. Part-time CPT, defined as 20 hours or fewer per week, does not count against your OPT. Many law students structure Trial Attorney placements as part-time to preserve their 12-month post-graduation OPT for a full-time position.
