Align your credentials to U.S. specialty occupation standards
The E-3 visa requires your role to meet the specialty occupation definition. Document that your Australian business or finance degree directly relates to agency ownership functions like risk assessment, underwriting oversight, and regulatory compliance.
Target independent agency networks over captive carriers
Independent agency groups and franchise networks are more practiced at sponsoring non-citizen owners than single-brand captive carriers. Search for groups that explicitly structure ownership agreements to accommodate visa holders as principal operators.
Clarify ownership structure before the LCA is filed
An agency owner who holds equity in the business can still qualify for E-3 status, but the employer-employee relationship must be clearly defined. Have your employer document their control over your role before DOL Labor Condition Application filing.
Use Migrate Mate's E-3 filing service for complex ownership arrangements
Agency owner roles involve equity structures that complicate standard visa paperwork. Migrate Mate's E-3 filing service manages the LCA, visa documentation, and consulate preparation, handling the structural complexity that trips up standard filings.
Request state insurance licensing timelines upfront
Every U.S. state requires an insurance producer or agency license before you can operate. Confirm with your prospective employer which state licenses they'll sponsor you for and whether they'll cover exam prep costs before you accept an offer.
Prepare for consulate questions about dual intent
E-3 visas require nonimmigrant intent, but agency ownership roles attract more scrutiny than employee roles. Bring documentation showing your Australian ties and the temporary nature of the arrangement to your consulate interview.
E-3 Visa Insurance Agency Owner: Frequently Asked Questions
How do I find Insurance Agency Owner jobs with E-3 visa sponsorship?
Migrate Mate lists Insurance Agency Owner positions from U.S. employers with active E-3 sponsorship history. Standard job boards rarely filter by visa type, so most Australians waste time applying to roles where the employer has never sponsored a visa. Migrate Mate surfaces employers who have already gone through the E-3 process, which significantly shortens your search.
How much does it cost to get an E-3 visa?
Migrate Mate's E-3 filing service covers the entire process for $499, including the Labor Condition Application, visa document preparation, and consulate appointment guidance. Traditional immigration lawyers charge $2,000–$5,000+ for the same work. The E-3 has less paperwork than most work visas, so paying thousands for legal help is usually unnecessary.
Does an Insurance Agency Owner role qualify as a specialty occupation for the E-3?
Yes, provided the role requires at minimum a bachelor's degree in business, finance, insurance, or a closely related field. The key is demonstrating that the position requires theoretical and practical application of specialized knowledge. Generic management experience alone won't satisfy USCIS. Your employer's job description must explicitly require a degree in a relevant discipline, not just prefer one.
How does the E-3 compare to the H-1B for an Insurance Agency Owner role?
The E-3 is available only to Australian nationals but has no annual cap and no lottery, so you can apply any time of year and start as soon as your visa is approved. The H-1B visa is subject to an annual lottery with roughly a one-in-four selection rate. For Australians, the E-3 is the clear path since it bypasses the lottery entirely and renews indefinitely with the same employer or a new one.
Can I own equity in the agency and still hold E-3 status?
Yes, but the employer-employee relationship must be genuine and documented. USCIS requires a qualifying entity to act as your employer and exercise meaningful control over your role, even if you hold a minority ownership stake. A sole proprietorship where you are your own employer does not qualify. The arrangement needs to be structured so another party, such as a franchisor or parent company, is the petitioning employer.
