Document your advanced degree credentials early
PERM requires your employer to verify your qualifications meet the job's minimum requirements. Gather official transcripts, credential evaluations for foreign degrees, and professional licenses before any offer letter stage to avoid delays.
Target financial institutions with PERM filing history
Banks, asset managers, and insurance companies sponsor AVP roles far more consistently than mid-market firms. Search DOL PERM disclosure data to confirm an employer has certified comparable positions before you invest time in their process.
Understand EB-2 versus EB-3 fit for your background
AVP roles requiring an advanced degree in finance, economics, or a related field typically qualify under EB-2. If your employer files EB-3, confirm the job description explicitly requires a bachelor's degree, not just a preference.
Use Migrate Mate to find green card sponsoring employers
Filter your AVP job search by employers with active green card sponsorship history using Migrate Mate. This narrows your target list to organizations already familiar with PERM timelines, reducing the friction of introducing the process to a new employer.
Negotiate PERM filing timing into your offer discussion
USCIS and DOL processing means green card sponsorship can take two or more years from PERM filing to I-485 approval. Confirm your employer is willing to initiate PERM within your first year, not after a lengthy probationary or promotion cycle.
Verify your prevailing wage tier matches your actual duties
Use the OFLC Wage Search to confirm whether your AVP role maps to a Level III or Level IV wage determination. A mismatch between your offered salary and the DOL wage level can require PERM refiling, resetting your timeline entirely.
Green Card Assistant Vice President: Frequently Asked Questions
Do Assistant Vice President roles commonly qualify for EB-2 or EB-3 green card sponsorship?
Most AVP roles in banking, finance, and corporate operations qualify for either EB-2 or EB-3 depending on the degree requirement built into the job description. EB-2 applies when the role genuinely requires an advanced degree. EB-3 covers positions requiring a bachelor's degree. Your employer's HR and immigration counsel determine the category based on the certified job duties, not your personal credentials alone.
How does the PERM green card process differ from H-1B sponsorship for an AVP role?
H-1B visa is a temporary, nonimmigrant status with a three-year initial period and no direct path to permanent residency on its own. PERM is the first step toward lawful permanent residency, with no annual lottery and no cap concerns at the EB-3 level for most nationalities outside India and China. The tradeoff is timeline: PERM, I-140, and adjustment of status together typically take two to four years, compared to a few months for an H-1B transfer.
How can I find AVP employers who actively sponsor green cards?
Migrate Mate lets you filter job searches specifically by employers with green card sponsorship history, so you're not cold-approaching companies unfamiliar with PERM. Targeting employers who have already certified similar AVP-level positions through DOL significantly increases your chance of a smooth, timeline-predictable sponsorship process.
What happens to my green card case if I change employers during the PERM process?
If you leave before your I-140 is approved, your PERM labor certification is tied to the sponsoring employer and generally cannot transfer. Once your I-140 is approved and your priority date is current, portability rules under AC21 may allow you to move to a same or similar role without restarting the process. Switching employers before I-140 approval typically means starting PERM from the beginning with a new sponsor.
Does the AVP job description affect which PERM wage level DOL assigns?
Yes, directly. DOL uses O*NET occupation codes and your job duties to assign a prevailing wage level between I and IV. AVP roles with supervisory responsibilities, specialized financial analysis, or portfolio management duties often map to Level III or IV, which carry higher wage requirements. If your offered salary falls below the assigned prevailing wage, your employer must either adjust compensation or reclassify the position before PERM can be certified.
