Frame your credentials for PERM documentation
PERM requires your employer to prove the role needs a specific degree. Gather your official transcripts, degree equivalency evaluations, and any advanced certifications now so your employer's attorney can define minimum requirements around your actual qualifications.
Target employers with active PERM filing histories
BD roles span every industry, so filter your search by companies that have filed PERM applications for business development or sales management positions. Use Migrate Mate to surface employers already sponsoring green cards in this occupation.
Verify your role clears the specialty occupation threshold
PERM audits frequently challenge business development roles by questioning whether a bachelor's degree in a specific field is genuinely required. Check the O*NET occupation profile for Business Development Managers and match your job duties to the listed knowledge requirements before accepting an offer.
Ask about the I-140 filing timeline during offer negotiations
Some employers file the I-140 concurrently with PERM approval; others wait months. For nationals from backlogged countries, an earlier I-140 approval date locks in your priority date sooner, so clarify your prospective employer's standard practice before signing.
Check prevailing wage before evaluating compensation packages
DOL sets a prevailing wage your employer must pay throughout the green card process. Run your target job title and location through the OFLC Wage Search before comparing offers so you can confirm each package meets PERM wage requirements.
Understand EB-2 versus EB-3 designation before your employer files
Business development roles can qualify under either category depending on how the position is defined. EB-2 requires an advanced degree or equivalent, while EB-3 covers roles requiring only a bachelor's degree. The category your employer selects affects your priority date queue, so confirm which tier applies before PERM is submitted to DOL.
Green Card Business Development Manager: Frequently Asked Questions
Does a Business Development Manager role qualify for EB-2 or EB-3 green card sponsorship?
It can qualify under either category. EB-2 applies when the position genuinely requires an advanced degree or when you have a bachelor's degree plus at least five years of progressive experience. EB-3 covers roles requiring a standard four-year bachelor's degree. How your employer writes the PERM job description determines which category applies, so the distinction matters before the labor certification is filed with DOL.
How does green card sponsorship differ from H-1B sponsorship for a BD Manager role?
H-1B visa is a temporary, nonimmigrant classification with an annual cap and lottery exposure. Employment-based green card sponsorship through PERM leads to permanent residency with no annual cap at the EB-3 level and no lottery. The tradeoff is timeline: PERM labor certification, I-140 approval, and adjustment of status typically take two to four years for most nationalities, compared to H-1B approval in a few months.
How do I find Business Development Manager jobs that offer green card sponsorship?
Search Migrate Mate to filter Business Development Manager roles by employers who have filed PERM labor certifications. Most standard job boards don't surface sponsorship history, so searching by DOL filing data gives you a far more accurate picture of which companies are genuinely open to sponsoring permanent residency for this role.
Can my employer start the PERM process before my H-1B expires?
Yes, and filing early is strongly advisable. PERM has no timing restriction tied to your current visa status, and starting the process while you're in valid H-1B status gives you AC21 portability rights once your I-140 is approved and your priority date becomes current. This lets you change employers in the same occupational classification without restarting the green card process from scratch.
What does the PERM recruitment process actually require for a BD Manager position?
Your employer must conduct a DOL-mandated recruitment campaign, including job postings, newspaper advertisements, and internal notice, to demonstrate no qualified U.S. workers are available for the role. For business development positions, USCIS and DOL auditors scrutinize whether the stated degree requirement is genuinely tied to the job duties, so the job description must accurately reflect the specialized nature of your responsibilities before the employer files.
