Green Card Licensed Mental Health Professional Jobs
Licensed Mental Health Professional roles qualify for EB-2 and EB-3 green card sponsorship through the PERM labor certification process. Employers file with DOL to demonstrate no qualified U.S. workers are available, then petition USCIS for permanent residency. State licensure requirements and clinical degree credentials are central to building a strong sponsorship case.

Verify your degree meets EB-2 requirements
EB-2 requires a master's degree or higher in counseling, clinical psychology, social work, or a related field. A bachelor's plus five years of progressive clinical experience won't satisfy EB-2 unless paired with an advanced degree credential evaluation.
Get your foreign credentials evaluated early
PERM requires your foreign degree to be evaluated as equivalent to a U.S. degree before the employer files. Use a NACES-member evaluation service, since DOL audits regularly flag credential documentation gaps in mental health filings.
Target employers with existing PERM filing history
Hospitals, community mental health centers, and federally qualified health centers sponsor green cards far more often than private practices. Search Migrate Mate to filter employers with active EB-2 and EB-3 sponsorship history for clinical roles.
Confirm your state license transfers before accepting offers
PERM locks in the job location, so your clinical license must be valid in that state at the time of filing. Reciprocity timelines vary widely; some states take six months or longer to approve licensure by endorsement.
Clarify the prevailing wage tier in your offer letter
DOL assigns a wage level (I through IV) during PERM based on your duties and supervision level. Ask your employer to request a Level III or IV prevailing wage determination through the OFLC Wage Search if your role involves independent clinical judgment.
Understand how PERM audit risk affects your timeline
DOL audits a significant share of PERM applications, adding six to twelve months to the process. Mental health roles with vague job duty language or broad education alternatives draw disproportionate audit scrutiny, so job description precision matters.
Green Card Licensed Mental Health Professional: Frequently Asked Questions
Does a Licensed Mental Health Professional role qualify for EB-2 or EB-3 sponsorship?
Most licensed clinical roles qualify for EB-3 as skilled workers requiring at least a bachelor's degree and licensure. If your position requires a master's degree as a minimum entry requirement, not just preferred, it can qualify for EB-2. The distinction depends on how your employer drafts the job requirements for PERM, not on your personal credentials alone.
How does green card sponsorship differ from H-1B sponsorship for this role?
H-1B visa is a temporary status capped at 85,000 new visas annually, subject to a lottery. Employment-based green card sponsorship through PERM leads to permanent residency with no annual cap at the EB-3 level for most countries. The tradeoff is timeline: PERM labor certification alone takes six months to over a year before USCIS even reviews the I-140 petition.
How do I find employers who sponsor green cards for mental health roles?
Search Migrate Mate to identify employers with a documented history of EB-2 and EB-3 sponsorship for licensed clinical and counseling positions. Federally qualified health centers, VA-affiliated programs, and hospital systems with behavioral health departments sponsor more consistently than outpatient private practices or solo group practices.
Can my employer start the PERM process while I'm on a work visa?
Yes. Employers can begin PERM labor certification while you hold H-1B or another temporary status. PERM and the subsequent I-140 filing are employer-driven, so your current visa status doesn't block the process. What matters is that you'll need valid status to file for adjustment of status or attend a consular interview once a visa number becomes available.
What clinical documentation should I prepare before a sponsoring employer starts PERM?
Gather your foreign degree credential evaluation, all state clinical license certificates, any supervised hours documentation your license required, and proof of any clinical supervisory roles. USCIS and DOL may request these during audit or RFE. Having them organized before your employer files reduces delays if DOL issues an audit notice mid-process.
