Verify your degree meets specialty occupation standards
USCIS requires your caregiver role to demand a specific bachelor's degree, not just any degree. Social work, gerontology, or nursing credentials tie your qualifications directly to the position and strengthen the specialty occupation argument.
Pull OFLC Wage Search data before negotiating
Look up the prevailing wage for your exact caregiver job title and county before your offer letter is drafted. Your employer's LCA must certify a wage at or above that figure, so knowing the threshold early prevents delays at filing.
Target employers with residential care licensing
Assisted living facilities, group homes, and certified home health agencies are more likely to have existing H-1B infrastructure than private household employers. Agencies operating across multiple states often have in-house HR familiar with LCA filings for direct-care staff.
Search Migrate Mate for verified H-1B caregiver employers
Filter by occupation and state on Migrate Mate to see which care organizations have active DOL Labor Condition Application history for caregiver roles. This saves time you'd otherwise spend cold-contacting employers who've never filed.
Clarify cap-exempt status with your prospective employer
Nonprofit healthcare organizations and government-affiliated care facilities may qualify as cap-exempt H-1B employers, letting you file outside the annual lottery. Ask HR directly whether the entity holds 501(c)(3) status and has filed cap-exempt petitions before.
Request premium processing if your start date is fixed
Caregiver roles often have state licensing requirements tied to employment start dates. USCIS premium processing cuts adjudication to 15 business days, giving you time to complete any required state background checks or credential verifications before your first day.
H-1B Visa Caregiver: Frequently Asked Questions
Do caregiver jobs qualify for H-1B sponsorship?
Some caregiver positions qualify, but the role must meet USCIS's specialty occupation standard, meaning it normally requires at least a bachelor's degree in a specific field like social work, nursing, or gerontology. General home aide or personal care aide roles that accept any background typically don't qualify. Roles in clinical or therapeutic care settings with formal degree requirements are stronger candidates.
Which types of employers sponsor H-1B visas for caregiver roles?
Residential care facilities, skilled nursing facilities, nonprofit disability service organizations, and hospital-affiliated home health programs are the employer types most likely to have H-1B filing experience for caregiving staff. Private household employers almost never sponsor H-1B visas. You can search employers with verified DOL Labor Condition Application history for caregiver roles directly on Migrate Mate.
What happens to my H-1B status if the care facility I work for closes or loses its license?
If your employer closes or your position is terminated, you enter a 60-day grace period during which you can find a new sponsor and file a transfer petition. H-1B portability under AC21 lets you start working for the new employer as soon as the transfer petition is filed, without waiting for approval, provided you've been in valid H-1B status for at least 12 months.
How does O*NET classify caregiver roles for H-1B purposes?
O*NET separates caregiving occupations by required education level. Roles like Personal Care Aide (SOC 31-1120) typically require only a high school diploma and don't support H-1B petitions. Roles like Social and Human Service Assistants or Residential Advisors that require a bachelor's degree fall under different SOC codes and can support a specialty occupation claim. Matching your job duties to the correct SOC code before filing matters significantly.
Can my employer transfer my H-1B to a new caregiver role at a different facility?
Yes, H-1B portability allows your new employer to file a transfer petition with USCIS while you continue working. The new employer must file a new LCA certified by DOL at the prevailing wage for the new location, since wages vary by county. Material changes to your job duties or work location require an amended petition rather than a straight transfer, so confirm the scope of the new role with the employer's HR team before accepting.
