Verify your degree aligns with the role
USCIS evaluates whether your degree field directly relates to a CTO's duties. A technical degree in computer science, engineering, or information systems is the clearest path. Unrelated degrees create specialty occupation RFE risk even at the executive level.
Target cap-exempt employers first
Universities, nonprofit research institutions, and government-affiliated entities can file H-1B petitions year-round without lottery exposure. CTO roles at these organizations are common in research computing and academic health systems, and you can start any time.
Search verified H-1B sponsors on Migrate Mate
Filter by CTO and senior technology executive roles on Migrate Mate to see employers with confirmed H-1B LCA filing history. You'll avoid wasting time on companies that have never sponsored and focus outreach on organizations with a documented track record.
Benchmark your prevailing wage before negotiating
Your employer's LCA must certify your salary meets the DOL prevailing wage for a CTO in their location. Use the OFLC Wage Search to look up Level III and Level IV wages for your metro area before entering offer negotiations so you know the floor.
Clarify equity compensation in your offer letter
CTO compensation packages typically include equity. USCIS scrutinizes whether the certified wage in the LCA reflects total cash compensation, not just base salary. Ensure your offer letter and LCA are consistent on what counts as wages before the petition is filed.
Plan for premium processing at the offer stage
USCIS premium processing upgrades adjudication to 15 business days for an additional fee. For CTO hires, where start dates are often tied to board approvals or funding rounds, requesting premium processing upfront prevents costly delays after the offer is signed.
H-1B Visa Chief Technology Officer: Frequently Asked Questions
Does a Chief Technology Officer role qualify as an H-1B specialty occupation?
Yes, a CTO role qualifies as a specialty occupation when the position requires a bachelor's degree or higher in a specific technical field such as computer science, software engineering, or information systems. USCIS focuses on the actual job duties, not the title. If the role includes significant non-technical management duties with no required technical degree, the employer will need to document that a specific technical degree is the normal minimum for the position.
Which employers sponsor H-1B visas for CTO positions?
Technology companies, enterprise software firms, financial services organizations, healthcare systems, and research universities all sponsor H-1B visas for CTO and senior technology leadership roles. Cap-exempt employers such as universities and nonprofit research organizations are particularly accessible because they can file outside the lottery. Migrate Mate shows employers with verified LCA filing history for technology executive roles, so you can prioritize outreach to organizations that have sponsored before.
How does the H-1B lottery affect CTO candidates?
Cap-subject CTO roles at for-profit companies enter the annual H-1B lottery, with registration open each March for an October 1 start date. If you're not selected, you can register again the following year or target cap-exempt employers in the meantime. Candidates already in valid H-1B status at another employer can transfer to a new CTO role at any time through an H-1B transfer, which does not require a new lottery entry.
Can a startup sponsor an H-1B visa for a CTO hire?
Yes, startups can sponsor H-1B visas, but USCIS scrutinizes whether the startup has a genuine employer-employee relationship with a CTO and sufficient ability to pay the certified wage. Evidence of funding rounds, revenue, payroll records, and a board structure that controls the CTO's employment all strengthen the petition. Early-stage startups with no funding history or payroll infrastructure face higher RFE rates and should work with experienced immigration counsel before filing.
What happens to an H-1B CTO if the company is acquired?
A corporate acquisition that qualifies as a successor-in-interest under USCIS rules allows the acquiring company to assume the existing H-1B petition without filing a new one, as long as the job duties and terms remain materially the same. If the acquisition changes the role significantly or the successor entity does not assume the petition, a new H-1B must be filed. The 60-day grace period applies if employment is terminated during the transition and you need time to arrange a new sponsor.
