Verify your degree supports specialty occupation
USCIS requires a direct relationship between your degree field and the Clinical Partner role. A nursing, health sciences, or allied health degree strengthens your petition. A general business or unrelated degree can trigger an RFE, so confirm the match before applying.
Check LCA filings by job title
Use the OFLC Wage Search to look up Labor Condition Application filings under 'Clinical Partner' and related SOC codes. This shows which health systems have actively sponsored this title, narrowing your employer targets to those with a proven filing history.
Target integrated health systems over staffing agencies
Hospital systems and accountable care organizations file H-1B petitions as direct employers, giving you cap-subject sponsorship with a stable employer of record. Staffing agencies that place clinical workers often use third-party arrangements that complicate your petition and wage documentation.
Search verified H-1B sponsors on Migrate Mate
Filter Clinical Partner openings on Migrate Mate to surface employers with confirmed H-1B filing history. This cuts the time spent cold-applying to employers who have never sponsored the role, so you focus on organizations already familiar with the process.
Confirm the prevailing wage tier before negotiating
The DOL assigns Clinical Partner roles a prevailing wage level based on your SOC code and work location. Your offered salary must meet or exceed that level for LCA certification. Check the OFLC Wage Search for your specific metro area before entering any compensation discussion.
Align your start date with H-1B cap timing
Cap-subject H-1B employment can't begin before October 1 of the fiscal year the petition is approved for. If you're on OPT, confirm your EAD expiration date and request cap-gap documentation from your DSO to stay authorized through the gap between OPT end and H-1B start.
H-1B Visa Clinical Partner: Frequently Asked Questions
Does a Clinical Partner role qualify as a specialty occupation for H-1B purposes?
It depends on how the employer defines the position. USCIS looks at whether the role normally requires a bachelor's degree or higher in a specific field, such as nursing, health sciences, or a related clinical discipline. Roles framed around generalized patient support without a degree requirement often fail this test, so reviewing the job description and the O*NET profile for the relevant SOC code before accepting an offer is worth doing.
Which types of employers sponsor H-1B visas for Clinical Partner positions?
Large integrated health systems, academic medical centers, and multisite ambulatory care networks are the most consistent H-1B sponsors for Clinical Partner roles. These organizations have in-house HR and legal infrastructure to manage LCA filings and USCIS petitions. Smaller independent clinics and private practices rarely sponsor this title. You can find employers with verified H-1B filing history for this role by searching Migrate Mate.
Can my employer file an H-1B petition for a Clinical Partner role while I'm on OPT?
Yes. If your employer files during the H-1B registration window in March, and your registration is selected, USCIS will target an October 1 start date. If your OPT expires before October 1, cap-gap rules automatically extend your work authorization from the OPT end date through September 30, provided you maintain F-1 status and your I-20 reflects the cap-gap extension. Your DSO updates the I-20 once the petition is filed.
What SOC code is typically used for Clinical Partner H-1B filings?
Employers most commonly file Clinical Partner roles under SOC codes tied to registered nursing, medical assistants, or healthcare support depending on the scope of duties. The SOC code directly determines your prevailing wage level, so a mismatch between your actual responsibilities and the filed code can create compliance problems. Confirm the SOC code with your employer before signing the offer letter and verify the wage level against the OFLC Wage Search for your work location.
What happens to my H-1B status if I change employers after being sponsored as a Clinical Partner?
H-1B portability under AC21 allows you to change employers after your petition has been pending for 180 days, provided the new role is in the same or a similar occupational classification. Your new employer must file an H-1B transfer petition before your current status expires. Clinical Partner roles that fall under the same SOC code and specialty occupation category generally satisfy the same-or-similar requirement, but your new employer's HR team should confirm this before your last day.
