Verify your role qualifies as specialty occupation
Pull the O*NET profile for Cloud Software Engineers and confirm the listed education requirements match your job duties. USCIS scrutinizes roles where job postings accept any bachelor's degree, so your offer letter should specify a directly related field.
Check prevailing wage tiers before negotiating
Run your job title and work location through OFLC Wage Search before you get to offer stage. Knowing which wage level your employer will certify helps you assess whether the offer meets the DOL threshold and avoids surprises at the LCA stage.
Target employers with cap-exempt filing access
Cloud roles at universities, nonprofit research institutions, and government-affiliated organizations are cap-exempt, meaning no lottery. If you're in a high-demand cloud specialty like distributed systems or infrastructure security, these employers compete for the same talent without the April filing window.
Filter employers by LCA filing history on Migrate Mate
Search Cloud Software Engineer roles on Migrate Mate to see which employers have active DOL Labor Condition Application filing history for this occupation code. That history confirms real sponsorship intent, not just a checkbox on a job posting.
Align your start date with the cap timeline
H-1B cap-subject petitions become effective October 1. If you're on OPT and your authorization expires before then, confirm your employer will file for a cap-gap extension. USCIS allows continued employment under cap-gap while your petition is pending.
Get cloud certifications documented before filing
AWS, Azure, and GCP certifications strengthen the specialty occupation argument for cloud-specific roles. Have your certification records and a credential evaluation of any foreign degree ready before your employer submits the I-129, since USCIS may issue an RFE if the degree-to-role connection isn't immediately clear.
H-1B Visa Cloud Software Engineer: Frequently Asked Questions
Does a Cloud Software Engineer role qualify as an H-1B specialty occupation?
Yes, cloud software engineering qualifies when the position requires at least a bachelor's degree in computer science, software engineering, or a closely related field. USCIS evaluates the job duties, not just the title. Roles where any bachelor's degree is listed as acceptable, regardless of field, can face RFEs, so your offer letter and the LCA should specify the required discipline.
How do I find employers who actually sponsor H-1B visas for cloud roles?
Search Cloud Software Engineer positions on Migrate Mate, which surfaces employers with verified DOL Labor Condition Application filing history for this occupation. LCA filings are public record and reflect actual sponsorship activity, not just stated willingness. Employers who have filed LCAs for cloud engineering roles in recent years are the most reliable targets.
Can I switch to a cloud engineering role mid-H-1B from a different tech specialty?
You can, but your new employer must file an amended H-1B petition before you start in the new role if the job duties or work location change materially. The LCA must also reflect the cloud-specific position. If your current H-1B was filed for a non-cloud role, a new petition is required even if both fall under software engineering.
Does remote work affect H-1B sponsorship for cloud engineers?
Yes. The LCA must list every worksite where you'll perform work, including your home address for remote roles. If you move or your work location changes, your employer may need to file a new or amended LCA with DOL. Cloud engineers working fully remote need to confirm their employer has a compliant worksite posting process before starting.
What happens to my H-1B if my cloud engineering employer is acquired or restructured?
If the acquiring company is a successor in interest and assumes your employment terms, USCIS allows continued work under the existing H-1B while an amended petition is filed. If the acquisition changes your role, employer EIN, or compensation materially, an amended I-129 is required. You can continue working during that processing window under the portability provisions of AC21.
